Toyohashi City Land Suit Judgment by Supreme Court July 22 17:39

After the war, a major textile manufacturer, Unitika, sought the citizens' complaint that it was a breach of contract to sell the land provided by Toyohashi City, Aichi Prefecture, five years ago to the Supreme Court. The decision to dismiss and the Mayor Toyohashi were ordered to order Unitika to claim about 2.1 billion yen.

In 1946, a major textile manufacturer Unitika sold 270,000 square meters of land provided by Toyohashi City as a factory site to a housing maker for ¥6.3 billion five years ago due to the closure of an office. Citizens of Toyohashi accused Mayor Toyohashi of being in breach of contract because Unitika had an obligation to return the land.

The case is proceeded with Unitika as an assistant participant of the city side, and the first instance judges that the sale to a third party is an illegal act and requests the mayor to charge Unitika full amount of 6.3 billion yen Ordered.

On the other hand, the second instance decided that it was obliged to return about 90,000 square meters of green space that was not used in factories, so it changed the first instance and ordered about 2.1 billion yen.

Both sides had appealed for this, but President Susumu Hayashi of the Supreme Court 3rd Small Court decided to reject both appeals by 22nd, and about 2.1 billion yen to Unitika to the mayor. The ruling ordering the claim has been finalized.
