Cannabis or cocaine users arrested on the public highway may not be brought to justice from the start of the new school year, but will instead receive an electronic report and a fixed fine (AFD), the ministry said. of the Interior Wednesday July 8, in a note which Le Point obtained .

The quantity of narcotic drugs found on the offender will be taken into account in the possibility of having recourse to an AFD. It should not exceed a ceiling of 10 grams for cocaine and 100 grams for cannabis. To have a chance to avoid legal proceedings, the drug user must also recognize the facts, be in possession of a valid identity document, be of full age and communicate a valid postal address.

The fine can range from 150 to 450 euros

If these conditions are met, police officers will be able to establish an AFD. The amount of the latter was established at 200 euros. It may however be reduced to 150 euros or increased to 450 euros. The procedure is supposed to take place at the scene of the arrest, but it can also take place in the premises of the police if necessary. The narcotic products and any accessories of the offender will be confiscated and destroyed.

This system has already been tested since June in the public security districts of Rennes, Reims, and the cities of Val-de-Marne, Créteil and Boissy-Saint-Léger. It will be extended on July 16 to the areas covered by the courts of Rennes, Reims, Créteil, Lille and Marseille, explains Le Point .
