The Court of Cassation gives the judge in a decision rendered Wednesday the opportunity to release a prisoner if he finds that the conditions of detention of the latter are unworthy.

France condemned by the ECHR

This judgment comes following a decision of the European Court of Human Rights (ECHR) in January which condemned France for its prison overcrowding. The Court of Cassation also referred the detainee's appeal to the Constitutional Council against a decision rejecting his request for release.
