  On the same day, "The 30th Anniversary Law Seminar on the Promulgation of the Basic Law of Hong Kong: How to Manage the Relationship between the Central Government and the Hong Kong Special Administrative Region Wisely" was held in Hong Kong. Tan Huizhu, Deputy Director of the Hong Kong Basic Law Committee of the NPC Standing Committee, Chen Hongyi, a member of the Hong Kong Basic Law Committee of the NPC Standing Committee, Liang Meifen, senior lawyers Feng Huajian and Qing Hong attended the meeting.

  Tan Huizhu said that in accordance with the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China (Hong Kong Basic Law), the Standing Committee of the National People’s Congress, after consulting the Basic Law Committee of the Hong Kong Special Administrative Region and the Government of the Hong Kong Special Administrative Region, may review the laws listed in Annex III of this Law Increases and decreases are made, and any laws listed in Annex III are limited to laws related to national defense, diplomacy, and other laws that do not fall within the autonomy of the Hong Kong Special Administrative Region in accordance with this Law. Therefore, even if the Central Government decides that no case in the Hong Kong Special Administrative Region’s National Security Protection Law will be handled by the Hong Kong Special Administrative Region, the jurisprudence makes sense.

  Tan Huizhu emphasized that national security matters belong to the central authority. The central government is able to refer and handle most cases that endanger national security under the jurisdiction and handling of the Hong Kong Special Administrative Region. This has demonstrated respect for the "two systems" and Hong Kong's high degree of autonomy has not been eroded.

  Chen Hongyi stated that according to the provisions of the Law on the Maintenance of National Security in the Hong Kong Special Administrative Region, “anyone who organizes, plans, implements or participates in the implementation of one of the following acts of using force, threatening the use of force, or other illegal means aimed at subverting state power is an offence” The mention of "using force, threatening to use force, or other illegal means" means that the "threshold" that constitutes the crime of subverting state power is higher.

  He also pointed out that the part of the legal provisions concerning the crime of colluding with foreign or foreign forces to endanger national security can be directed against some people who demand foreign sanctions against Hong Kong.

  Feng Huajian pointed out that the Chief Executive of the Hong Kong Special Administrative Region should appoint a number of judges from the magistrates, district court judges, judges of the Court of First Instance of the High Court, judges of the Court of Appeal and judges of the Court of Final Appeal. Judges are responsible for handling crimes against national security. It is a more reasonable approach; and the Chief Executive may consult with the Chief Justice of the National Security Council and the Court of Final Appeal of the Hong Kong Special Administrative Region before appointing judges to understand the performance and level of judges. Help to select the most suitable person.

  He also mentioned that since the return of Hong Kong 23 years ago, the failure to complete the local legislative work of Article 23 of the Hong Kong Basic Law has left Hong Kong with a legal loophole in safeguarding national security. The Hong Kong Special Administrative Region’s Law on the Maintenance of National Security has exemplified Hong Kong’s high degree of autonomy.

  Liang Meifen believes that the content of the Hong Kong Special Administrative Region’s National Security Law fully reflects "one country, two systems." As a national law, the Hong Kong Special Administrative Region’s National Security Law has fully taken into account the situation in Hong Kong. Safeguarding national sovereignty, unity and territorial integrity is also an important element of "one country, two systems".
