Schools and colleges reopen Monday for all students. Since the reopening of schools in mid-May, only 1.8 million schoolchildren - out of a total of 6.7 million - have returned to school and 600,000 out of 3.3 million in college, rarely full-time. Two weeks before school holidays, this return to school worries many readers.

“My 9 year old daughter is looked after by her grandparents. Does she have to go to school? " The count

“Will going back to college always be on a voluntary basis? I don't want to put my daughter back in college until September "Sophie

"Mom of fragile health, considered as very vulnerable, what are the repercussions if I do not put my 12 year old child back in college on June 22 and if I continue distance education as on March 17? " The cause

“With a health problem, however small, should I send my three children to school? For ten days of school, should we take the risk with the Covid and what are the remedies if I take a fine of € 1,500 where my parental authority is forfeited? »Adrien

Here are the answers we found:

A mandatory presence. President Emmanuel Macron announced on Sunday "In France and overseas, the nurseries, schools, colleges will prepare to welcome from June 22 all students on a mandatory basis and according to the rules of normal presence."

A return to normal, even for two weeks, which was underlined this Thursday morning by the Minister of National Education Jean-Michel Blanquer, on France Info: “Education is compulsory. It has always been compulsory, even in the previous period, either remotely or coming. We come back to the compulsory physical presence, in the usual framework, we have to come to school. "

Note that, if the law provides that "education is compulsory for each child from the age of 3 and up to the age of 16", (Article L131-1 of the Education Code), high school students are not affected by this compulsory return. On the other hand, the lycées which have been able to reopen will have the right to welcome a greater number of pupils, according to the Ministry of Education.

Sanctions provided. What happens if a child does not come to class? "Aren't we going to send the police to the families?" "To this question asked by France Info, the Minister of Education Jean-Michel Blanquer replied" That is for sure ", adding:" Our goal is that as many students as possible return, it is above all a social goal. "

However, the return to normal means that the absence of children from 3 years old must be justified by the parents, especially if they last more than three days. From the first absence, the school contacts the family. According to Public Service, after 4 half days of unjustified absence in a month, support is offered to parents. Beyond 10 half-days, the director must inform his hierarchy, before a possible referral to the public prosecutor. Article 227-17 of the Criminal Code specifies that compromising the education of a minor child is punishable by two years' imprisonment and a fine of € 30,000.

An exceptional context. If it is possible to produce a medical certificate to explain that a child is not able to follow the courses, what about the parents? Their state of health or their concern related to the disease does not come under a "normal" situation.

Contacted by 20 Minutes, a union representative explains that in the absence of specific directives, each school will in fact have to manage the situation on a case-by-case basis. “We are awaiting a directive from the ministry, the teams are left a little alone on the ground. We understand that families are worried, we must be in dialogue and reassure. Clearly, parents will have the opportunity to justify the absence of their child to the school head. In practice, the situation will not be the same if there are a few isolated cases or massive absenteeism throughout the territory. "Parents risk absolutely nothing," ruled Monday, on LCI, Jean-Rémi Girard, president of the National Union of high schools and colleges.
