Six years after the disappearance of 14-year-old girl Xiao Mo (pseudonym) in Zhumadian City, Henan Province, when she was found by her mother, she had given birth to three children for Zheng Moumin and Zheng Mouniu. The lead criminal Zheng Moumin was sentenced to 15 years in prison by the Zhumadian Yicheng District Court for rape on January 20, 2020. He subsequently appealed. On June 10, Peng Mei News (www.thepaper.cn) learned from Xiao Mo's attorney Zhao Liangshan that in the morning of the same day, Zhumadian Intermediate People's Court issued a remote video sentence against Zheng Moumin, maintaining the previous judgment of the first instance.
According to previous reports from Peng Mei News, around May 2012, 14-year-old Xiao Mo ran away from home after a quarrel with his brother. There has been no news for the next six years. Until January 2018, when Xiaomo was discovered by her mother outside a community in Zhumadian City, she had become the mother of three children.
According to Xiaomo, after she ran away from home in 2012, she met Zheng Moumin on the roadside, and was then taken back to Zheng Moumin's home by tricycle. After appraisal, the police confirmed that among the three children of Xiaomo, the boss was born by Xiaomo and Zheng Moumin, and another pair of twins were born by Xiaomo and Zheng Moumin's son Zheng Mouniu.
On November 21, 2018, the Cedar Branch of Zhumadian Public Security Bureau detained Zheng Moumin in criminal detention. On May 29, 2019, the People's Procuratorate of Yicheng District, Zhumadian City filed a public prosecution against Zheng Moumin for the crime of rape. Zheng Mouniu was identified as "meeting the diagnostic criteria for schizophrenia when committing the crime" and handled it separately.
On October 31, 2019, the case was first heard in the Yicheng District Court. On January 20, 2020, the Yicheng District Court sentenced Zheng Moumin to 15 years’ imprisonment for rape and ordered Zheng Moumin to compensate Xiaomo for 32297.94 yuan in economic losses. Zheng Moumin refused to accept the appeal. On June 10, the Zhumadian Intermediate Court rejected the appeal in the second instance ruling and upheld the original verdict.
According to Zhao Liangshan, Xiaomo’s attorney, the Zhumadian Intermediate Court found in the final ruling that Zheng Moumin was the principal criminal involved in the rape, and his son Zheng Mouniu was an accomplice. The court of the original trial sentenced Zheng Moumin for the bad crime and serious consequences. 15 years of fixed-term imprisonment is appropriate.
Previously, Xiao Mo had mentioned that he had been abused and illegally detained at Zheng’s home. The Zhumadian Intermediate Court held that the court did not hear the above case because the public prosecution agency did not initiate a public prosecution. The missing complaint filed a complaint with the relevant authorities, "The victim may file a separate lawsuit against the child's custody rights and subsequent compensation costs incurred by the victim."
Zhao Liangshan said that in the next step, the injured party will bring a separate lawsuit to the Yicheng District Court for the attribution of the custody of Xiaomo’s three children, the bearing of the maintenance expenses and the subsequent compensation costs of the victim. , Illegal detention, and criminal investigation of Zheng Mouniu, etc., continue to file charges and complaints with public security organs."
