  • A month after the promulgation of the decree authorizing the reopening of primary schools, several communes in the Gard were resisting. They felt that they were unable to ensure the safety of children and teachers.

Seized in interim release by the prefecture of Gard, the administrative court of Nîmes ordered the reopening of the primary schools of five communes of the department which kept their establishments closed. Since May 11, the government has requested the reopening of schools for children in the first grade. The prefect had particularly deplored the deadlock of "the attempt to dialogue in order to assess the impossibility of accommodating on the premises of the town even a very small number of students".

The villages of Cornillon, Domessargues, Le Martinet, Moulézan and Saint-André-de-Valborgne are obliged to reopen the establishments from Monday 15 June. "The judge in summary proceedings notes that the municipalities concerned have produced nothing before him to characterize the existence of compelling reasons specific to their situation justifying the use by the mayor of his general police powers", details the court in his order. He deduced from this that "the contested decrees refusing to reopen the schools seriously and manifestly unlawfully violate the fundamental freedom represented by the right to education and instruction". The decisions of these five villages are therefore suspended.

Under other legal threats, two other municipalities have decided to reopen schools

Two other municipalities in the Gard - Cendras and Saint-Michel d'Euzet - which were also to be the subject of proceedings for interim measures on Wednesday, finally announced the reopening of the schools on Monday. To justify this closure, Elian Petitjean, the mayor of Saint-Michel d'Euzet, considered that “the rigorous application of the health protocol of the Ministry of National Education was too restrictive for [his] municipality. And that it did not ensure the health security of children and teachers. "

On the other hand, the primary schools of the commune of Beaucaire will remain closed until the start of the September school year. Initially, the municipal decree had also been attacked before the administrative court by the prefect of Gard. But the state representative withdrew his request.

In Beaucaire, on the other hand, we will remain closed

In this city located on the banks of the Rhône, a three-year-old child attending a private school tested positive for coronavirus in early June. And the city, at the gates of Bouches-du-Rhône, is also close to a center of infection linked to seasonal workers. 17 positive cases were detected there. The mayor, Julien Sanchez (RN), was worried about these possible reopenings, while "agricultural workers from Latin America (...) themselves have children of school age".

Faced with the presence of this infectious focus, "the screening campaign continues," says the prefecture. In collaboration with the services of the city of Beaucaire, a screening center will be open at the sports hall for three days, until Friday.
