  In 2017, in a shopping process, Miao Xiaodan found that the baby rice noodles she bought had agglomeration, so she complained to the customer service of the website and requested a refund for the return of the product.   It turned out that most of the products on the Haitao website were mailed overseas. For food commodities with small amounts, the return and exchange process takes a long time, the freight cost is high, and the goods returned to the warehouse cannot be sold again.   Due to the loss of the online store that he operates, his own demand for these consumables is relatively large. After accidentally learning of this rule, Miao Xiaodan immediately ordered a batch of snacks, and after receiving the goods, the snack was approaching the shelf life as a reason to the customer service. Request a refund. Looking at the more than 500 yuan refund that arrived soon, and remembering the loss caused by the previous online store, she had the idea of ​​using the return rules to cheat money and make up for her losses.

  At first, she only applied for a refund of snacks worth several hundred yuan. As the amount accumulated, she already made up for the loss of the online store, but under the greed, Miao Xiaodan continued to cheat to refund the goods.

  In the following year, Miao Xiaodan successively registered 35 accounts on the Haitao website. After purchasing baby rice noodles, snacks, skin care products and other items many times, the fictional goods expired, the packaging was damaged, and the wrong goods were sent. When the customer service requested a photo of the defective product, she sent the photo she had PS.

  Until December 2017, Manager Zhang of the security department of the Haitao website received feedback from customer service that customers in Wuxi frequently complained about refunds, mostly because of expired products and damaged packaging. However, after checking the background data of the website and the situation of the goods in and out of the warehouse, it was found that these products did not have problems beyond the shelf life.

  Manager Zhang further investigates and finds that the actual users of multiple accounts showing abnormalities in the area are all the same person. The customer uses different accounts to purchase consumables such as food, skin care products, baby products, etc., and then applies for a refund for different reasons within one or two days after receipt. According to the website's policy of "refund and no return" for such products, the customer service directly sent the refund to the payment account without asking the customer to send the product back.

  In January 2018, the shopping website tightened the refund policy for this user, requiring him to provide a picture of the expired or damaged goods when applying for a refund, and must return the purchased goods by mail and only after the company has verified it. paragraph. Manager Zhang found that the number of returns from this user has decreased significantly since then, but there will still be orders to request returns, and the pictures used as the basis for returns will be generated by PS after technical analysis. The shopping website confirmed that the user was using the refund rules to defraud, so he called the police.

  Soon, Miao Xiaodan was captured by public security organs. But before that, she had applied for multiple refunds on the shopping website 77 times with multiple accounts, and got a total of 28,000 yuan in refunds and more than 1,600 US dollars in fraud. After the incident, Miao Xiaodan's family paid back all the money and obtained the victim's understanding.

  After examination, the Huishan District Procuratorate in Wuxi City believed that Miao Xiaodan had used illegal possession for the purpose of defrauding property, and should be held criminally responsible for the crime of fraud, and prosecuted in November 2019. Miao Xiaodan has no objection to the criminal facts, charges and sentencing suggestions charged by the procuratorate, and has voluntarily pleaded guilty. After hearing the case, the court held that the charges prosecuted by the procuratorial organ were justified, so it made the above judgment according to law.
