The defendant Leng Lan refused to accept the retrial decision and has appealed.

  According to the report, the defendant Leng Lan of the first trial was sentenced to three years ’imprisonment and five years’ probation for committing intentional injury (causing death) in December 2006. The People's Procuratorate of Lijiang City filed a protest in November 2019, and the Municipal Intermediate People's Court issued an order for retrial in December 2019. The Huaping County People's Court held a public hearing in March 2020 to conduct the trial.

  Upon reexamination, it was found that the first trial defendant Leng Lan's husband Liu Mou and Zeng Mou had extramarital affairs. On the evening of June 23, 2006, the victim Zeng Mou had a dispute with Liu Mou in his rented apartment. Zeng Mou called Leng Lan several times and asked Leng Lan to go to get someone. At 22:40, Leng Lan brought a fruit knife into Zeng Mou's rented house. "The two of them clashed. Leng Lan stabbed Zeng Mou's abdomen and scratched his left wrist with a fruit knife. Zeng Mou was sent to the hospital and died. Only Leng Lan, Liu Mou and Zeng Mou were present at the time of the attack.

  After trial, the defendant Leng Lan went to Zeng Mou's residence with a fruit knife, and there was a conflict in the rented house. Zeng was stabbed to death, and his behavior constituted the crime of intentional injury (causing death). Leng Lan and his defender did not constitute a criminal defense and defense opinion, which was inconsistent with evidence such as the witness testimony and on-site inspection transcripts. In view of the victim's fault of interfering with others' marriage cigarettes, Leng Lan had surrendered to the plot and reached an economic compensation agreement with the victim's family and fulfilled it. To this end, on April 15, 2020, the verdict of the original trial defendant Leng Lan committed the crime of intentional injury and sentenced to seven years in prison.
