The agricultural sector lacks arms due to the closing of borders to stop the spread of the new coronavirus. - Isa Harsin

Whether it is for fear of losing part of his salary or for fear of finding himself idle, even useless, readers of 20 Minutes put on partial unemployment due to the health crisis linked to the new coronavirus wonder if they can find a additional job:

“I am on a permanent contract put on partial unemployment because of the Covid-19. Do I have the right to find another job while I am unemployed? »Corentin

“I heard on the news that many fruit and vegetable picking stations were available. I am currently on short-time working, I wanted to know if it was possible to combine the benefits of short-time working and in addition a job of collecting fruits and vegetables without losing the first benefits? If yes, under what conditions should it be done? »Silvere

Here are the answers we found:

The law authorizes an employee to combine several jobs, it is indicated, among others, on the site of the French administration, Service-public.fr. He can therefore benefit from the partial activity allowance and the remuneration linked to the other job. But this, under several conditions.

First of all, he must respect the “obligation of loyalty”, that is to say that he cannot exercise an activity which can compete with that of his employer. Cumulation may be prohibited by contractual provisions or a clause in the employment contract, such as that of exclusivity (which applies even if the activity does not compete with that of the employer). So be sure to check your employment contract, if you want to apply for another job. But also to notify your first employer, to specify the name of the one for whom you are going to work, as well as the duration of your contract.

Another condition: whatever the number of employers, or the duration of each contract, the employee must respect the maximum legal duration of work registered in the Labor Code. In normal times, the latter should not exceed more than ten hours per day and forty-eight hours per week. However, since Ordinance No. 2020-323 of March 25, 2020, it can be extended to twelve hours a day, and sixty hours a week. Only “in the sectors particularly necessary for the security of the nation and the continuity of economic and social life”, and this until December 31, 2020. The sectors concerned by these derogations will be the subject of a decree, a clarified the Minister of Labor, Muriel Pénicaud, Tuesday March 24. We already know that the agricultural and food sector is one of them.

To "provide everyone with uninterrupted access to healthy and quality food", farmers need labor, insisted Muriel Pénicaud and his counterparts at the Ministry of Economy and Finance, Bruno Le Maire , and at the Ministry of Agriculture and Food, Didier Guillaume. This pool is usually made up of foreign seasonal workers, who can no longer move freely since the borders were closed to stop the spread of the new coronavirus.

Will Corentin and Silvere be tempted?
