Murder and burial, the local police has not filed for 16 years

The murder case 16 years ago occurred on January 22, 2003.

The 53-year-old Deng Shiping had taught mathematics and fine arts in elementary and middle schools. Before the incident, he was a staff member of the General Office of No. 1 Middle School of Xinhuang County, responsible for the quality supervision of the 400-meter track and field project of the school; Du Shaoping, 12 years younger than him It was the actual contractor of the track and field project that year.

During the construction process, Deng Shiping questioned the quality of the project. Du Shaoping believed that "the road to wealth was blocked", and he discussed with Luo Guangzhong under his command to murder Deng Shiping.

The first-instance judgment of the Huaihua Intermediate Court found the fact that Du Shaoping and Luo Guangzhong deliberately murdered: On the morning of January 22, 2003, in the project department office of Xinhuang No. 1 Middle School, Du Shaoping mixed the pre-prepared "drug" into the beverage for Deng Shiping drank, and then let Luo Guangzhong shout away the teacher Yao Benying who was playing chess with Deng Shiping on the pretext of sending oranges. On the fourth day of Deng Shiping's "disappearance," his wife reported to the Xinhuang County Public Security Bureau, suspecting that her husband had been killed. Two weeks later, Deng Shiping ’s younger brother Deng Huangping accused Du Shaoping of killing the police and provided relevant clues: Du Shaoping and Deng Shiping had conflicts due to engineering quality issues. Du was the last person to contact Deng Shiping. Deng Shiping was missing the next day. Fill the playground pit.

Because the Xinhuang County Public Security Bureau has not filed a case, the family of Deng Shiping sued the provincial and municipal authorities. On March 7, 2003, the relevant leaders of the Political and Legal Committee of the Huaihua Municipal Committee instructed that the Xinhuang County Public Security Bureau "should file a case for investigation"; on April 17, the same year, the Huaihua Municipal Public Security Bureau received the instructions from the relevant leaders of the Criminal Investigation Team of the Hunan Provincial Public Security Department-request Yang Xuewen, deputy director of the Criminal Investigation Bureau of the Huaihua Municipal Public Security Bureau, urged and directly participated in the verification of the case. On May 28, 2003, Yang Xuewen went to Xinhuang County to organize a case analysis meeting. After hearing the case report, he decided to "adjust the direction". After that, the task force formed a written report that Deng Shiping's disappearance did not meet the conditions for filing the case, and concluded: "Du Shaoping does not have the conditions to kill Deng Shiping."

However, no official investigation was conducted on the last track and field project department office before Deng Shiping's disappearance.

In March 2003, the Criminal Police Detachment of the Public Security Bureau of Huaihua City arranged an investigator and deputy director of the forensic medical department, Deng Shuisheng, to guide and participate in the investigation of the Deng Shiping case. On the 27th of the month, Deng Shuisheng and the police of the task force conducted a site survey on the project department office suspected of committing the crime. At this time, two months have passed since Deng Shiping disappeared. Deng Shuisheng and others found and extracted blood on the wall of the office.

Deng Shiping, Deng Shiping's younger brother, recalled that when Deng Shuisheng and others entered the project department office at that time, the site was actually cleaned. "After the blood sample was taken, Officer Deng said to my mother that it can be identified by matching the DNA with blood stains." Deng Huangping said that he did not expect that the later identification of the matter "cannot be done."

The Jingzhou County Court heard and found that Deng Shuisheng and others did not immediately send blood samples after taking blood from the scene. Ten days later, the Criminal Police Brigade of Xinhuang County Public Security Bureau concealed the discovery and extraction of suspected blood from the scene in the written report.

It was not until May 22, 2003, nearly two months after the blood stains were taken, that the team leader Cao Riquan sent the blood stain samples to the Hunan Provincial Public Security Bureau for inspection. After half a month, the inspection and identification results came out: bleeding traces were detected, but the DNA map was not detected due to too little amount and soil contamination.

It took two months for the case to go to the scene to investigate and extract blood stains, and after obtaining the blood stains on the scene, it was delayed for another two months before being sent for inspection. These operations of the police handling the case were obviously too "abnormal."

In December 2019, Liu Hua (pseudonym) analyzed the case hearing and judgment in the court of Jingzhou County. If the case is issued that year, the police will go to the scene to investigate, extract blood stains and send them to the test in time, or the volatilization of blood stains may be avoided And pollution; if the blood spot on the scene was detected by Deng Shiping, then the police must definitely file a criminal case.

In fact, at the end of May 2003, when the local police reported to the Hunan Provincial Public Security Bureau, they also concealed the important situation of blood sampling from the scene.

Behind the refusal to dig the playground: formal investigation and reporting "techniques"

On the evening of June 18, 2019, several excavators successively entered the playground of Xinyi No.1 Middle School.

In the evening of the next day, an excavator digs out a few large stones in the deep pit, and then digs a shovel into the soil layer inside. A human skull emerges from the mud in the bucket. In the next few hours, the excavated remains were stitched together by technicians into a human silhouette. Subsequent appraisal results indicated that the remains were the victims of Deng Shiping-they had been buried under the playground for 16 years.

In fact, 16 years ago, various parties had conducted a "game" around whether to dig the playground.

Deng Shiping's family certainly wanted to dig the playground, but they couldn't decide. At that time, Huang Bingsong, the principal of Xinhuang No. 1 Middle School, opposed the excavation of the playground. He appeared to be out of public opinion-there was no evidence at that time that Deng Shiping was buried under the playground, and this new playground is the school's "face", which will be used to celebrate the school Xian Qing, who applied for the provincial key middle school, started excavation as soon as it was built, and "had a bad influence"; in fact, Huang Bingsong was hiding his selfishness-the murderer Du Shaoping accused by Deng Shiping's family was his pro-nephew.

The first-instance verdict shows that three months after the case was issued that year, Sheng Deyuan, then the head of the Criminal Police Corps of the Hunan Provincial Public Security Department, issued an instruction requesting the Huaihua police to "make sure to investigate and deal with the case"; the deputy leader Yang Bingquan's instructions were more specific. He asked the public security organs of Huaihua and Xinhuang to conduct a detailed survey of the site, "deeply investigate the two earth pits pushed by the bulldozer."

After receiving instructions from the Provincial Public Security Department, Jiang Aiguo, then director of the Public Security Bureau of Xinhuang County, contacted Xinhuang No. 1 Middle School to contact the excavation playground because Huang Bingsong disagreed with the excavation for various reasons, and the county leaders also supported the school ’s opinion. Decided not to excavate the playground for the time being.

Why is Huang Bingsong's attitude of refusing to dig the playground so determined? Because he "knows his heart"-his nephew Du Shaoping is a murderer.

More than 20 days after Deng Shiping "disappeared", facing various rumors, Huang Bingsong questioned his nephew Du Shaoping, who admitted the fact that Deng Shiping was killed. After that, Huang Bingsong began "activities", looking for local party and government leaders and public security organ leaders to stop digging the playground and try to cover up Du Shaoping's murder.

Later, the local police's internal voice for digging into playgrounds also became smaller—there were no breakthroughs in several formal investigations. Sixteen years after the incident, the prosecution ’s review and the court ’s trial restored some details of the police ’s handling of the case that year:

On April 2, 2003, the case handler called Du Shaoping's mobile phone call list, and found that within 12 hours after Deng Shiping's disappearance, Du Shaoping held 19 calls between the two mobile phone numbers, but did not respond to these abnormal conversations. Further verification.

On April 25 of that year, when the case-handling policeman Chen Ling et al. Took evidence from the important witness Li Moumou, under the arrangement of the special team leader Cao Riquan, Du Shaoping, who was determined to be suspected of major crimes, "accompanied the investigation". After the investigation of the case, the police accepted Du Shaoping's food.

On May 17 and 18, 2003, Deng Shuisheng, Liu Hongbo, Cao Riquan, Chen Shoutian, Chen Ling and other case-handling officers summoned Du Shaoping for questioning according to the arrangement of the previous case analysis meeting. "During the interrogation process, we did not carry out targeted interrogation based on the doubtful points found in the previous investigation, only made procedural interrogations, and took technical investigation measures symbolically, and removed them after only one night of use."

According to the lawyer Wang Hui (pseudonym) who checked the case file, the measures taken by the case-handler at that time were to conduct a sudden trial of the Du Shaoping couple during the day, "I want to listen to them by knocking on the mountain and listening to the tiger, how to discuss the countermeasures at night." Hearings installed monitoring equipment. "But that night was calm and calm. Du Shaoping and his wife slept in separate beds and didn't talk about anything." Wang Hui said that when he was later investigated, some of the investigators in the year suspected that they "leaked the wind" when taking technical investigations.

The technical investigation methods did not work, and the case-handling staff conducted a simple "on-site simulation reproduction" upstairs and downstairs of the project department. According to this, "the conclusion that Du Shaoping did not have the time to commit crimes" was directly formed.

On May 28, 2003, Yang Xuewen, who was in charge of the criminal investigation work in Huaihua City, once again went to Xinhuang County to supervise the Deng Shiping case. After reporting the investigation, Liu Hongbo, deputy director of the Xinhuang County Public Security Bureau, and members of the ad hoc group suggested adjusting the direction and re-investigating Deng Shiping ’s deep social relations. Yang Xuewen made the decision to "adjust the direction and shift the focus", and no longer mention the excavation of the playground.

How does the case handling unit report to the Provincial Public Security Department? Later, the court found out that the facts showed that at the end of May 2003, Liu Hongbo and the members of the ad hoc group jointly discussed and formed a written investigation report reported to the higher public security organ. This report conceals evidence and clues such as blood sampling from the missing site, obvious abnormality in the operation of the bulldozer, and the contradiction between Deng Shiping and Du Shaoping, and believes that no foreign objects were found during the operation of the bulldozer and there is no need to dig the playground; there is no direct evidence and The clue does not meet the conditions for filing.

The above report also made a conclusion: "Du Shaoping does not have the conditions to kill Deng Shiping." After the report was reviewed by Yang Xuewen, the Criminal Police Division of the Huaihua City Public Security Bureau reported to the Hunan Provincial Public Security Bureau accordingly; the Criminal Police Brigade of the Xinhuang County Public Security Bureau also responded to the inspection room of the Xinhuang County Committee with "Du Shaoping does not have the conditions to kill Deng Shiping."

Since then, the public security organs at Huaihua and Xinhuang have not investigated the disappearance of Deng Shiping. It was not until 16 years later that the Central Anti-Corruption Supervision Group, which received the accused materials from Deng Shiping ’s family, intervened in the supervision. Judging from the facts found in the court of first instance, after the case, Huang Bingsong, as the principal of the "highest institution of higher learning" in Xinhuang County, took full advantage of his deep local connections. Some old leaders, old colleagues, fellow villagers and students have become "resources" for Huang Bingsong to seek asylum for his nephew. He and Du Shaoping weaved a huge extrajudicial network with human relations and interests as trading weights.

Of the 10 "protective umbrellas" in this case, Huang Bingsong and Yang Jun were the most severely sentenced in the first instance-both were sentenced to 15 years in prison for favoritism. In fact, Huang and Yang played an important role in the entire assassination process.

Yang Jun, born in 1962, is the same age as Du Shaoping, and they are middle school classmates. Yang Jun graduated from the Hunan Provincial People's Public Security School and served as the deputy inspector general of the Xinhuang County Procuratorate. When Deng Shiping "disappeared" in 2003, he was the political commissar of Xinhuang County Public Security Bureau. Later, he served as the director of Xinhuang County Public Security Bureau and Zhijiang County Public Security Bureau.

The court heard that after Deng Shiping "disappeared", Du Shaoping gave Yang Jun tobacco and alcohol and 5,000 yuan in cash in the name of New Year's greetings around the Spring Festival.

Yang Jun is also a student of Huang Bingsong. Before the Lantern Festival in 2003, more than 20 days after Deng lost his "missing", Huang Bingsong gave Yang Jun 5,000 yuan in cash at the entrance of Xinhuang No.1 Middle School. The day after the Lantern Festival, Huang Bingsong again found Yang Jun and told him that Du Shaoping had killed Deng Shiping. He asked Yang Jun to help lead the case to the "missing" direction for investigation. Yang Jun agreed.

Later, according to Yang Jun's statement, he was nervous when he accepted Huang Bingsong's request. He was worried that if he didn't "help", Huang Bingsong and Du Shaoping would sue him and tell him that he had previously received tobacco, alcohol and red envelopes, and he would be held accountable.

The court found that during the handling of the case after Deng Shiping's disappearance, Yang Jun used the identity of the political commissar of the Public Security Bureau to cover Du Shaoping from criminal prosecution, and disclosed the case and the investigation progress of the police to Huang Bingsong several times. When discussing the case with the policeman handling the case, Yang The military also issued its opinion that "Deng Shiping's case is a missing case."

In May 2004, a year after the burial of the playground, Yang Jun was promoted to director of the Xinhuang County Public Security Bureau. Although the family of Deng Shiping continued to appeal to the Xinhuang County Public Security Bureau, Yang Jun did not arrange for the case investigator to continue the investigation for more than two years as the "leader", "I don't want to turn this case out."

The court also found out that Liu Hongbo, the deputy director of the Xinhuang County Public Security Bureau, Cao Riquan, the captain of the criminal police, Chen Shoudian, the deputy captain, and Chen Ling, the investigator, etc., in the process of handling the case, knew that Yang Jun and Du Shaoping were in a classmate relationship. Love, cater to and agree with Yang Jun's opinions.

Cao Riquan, who was the team leader at the time, later explained that he knew that Yang Jun and Du Shaoping were in a classmate relationship, but he reported and asked the case about it because he was afraid of offending Yang Jun and affecting his career.

In the preliminary investigation stage of the case, Huang Bingsong repeatedly hosted members of the special case such as Liu Hongbo and Cao Riquan; between 2004 and 2005, the policeman handling the case, Chen Ling, operated the Dulang Lang Klang Valley KTV for multiple exemptions;

On December 30, 2019, the Jingzhou County Court sentenced that Deng Shuisheng, Liu Hongbo, Cao Riquan, Chen Shoudian, and Chen Ling, the Deng Shiping case, all constituted a crime of favoritism: knowing that Du Shaoping was suspected of killing Deng Shiping. In the case of deliberately covering up the case, the case is classified as a missing case, and the case will not be filed.

Cao Riquan, as the captain of the Criminal Police Brigade of Xinhuang County Public Security Bureau at the time, and the team leader of the Deng Shiping case, played a central role in the investigation phase. Deng Shuisheng, born in 1949, is from Xinhuang County. Among the 10 public officials sentenced in Deng Shiping's case, his sentence was second only to Huang Bingsong and Yang Jun-who was sentenced to 14 years in prison for favoritism.

In July 2019, Deng Shuisheng was put on detention by the Huaihua City Supervision Commission, and was later detained, arrested, and prosecuted.

In March 2003, when Deng Shiping "disappeared" for two months, the investigation of Xinhuang County Public Security Bureau still had no substantial progress. It was then that Deng Shui was born Xin Huang.

At that time, Deng Shuisheng, as a forensic investigator and deputy director of the forensic division of the Criminal Police Division of the Huaihua City Public Security Bureau, guided and participated in the investigation of the Deng Shiping case according to the leadership's arrangement.

After arriving in Xinhuang, Deng Shuisheng immediately went to the site to investigate. In the office of the project department that had been cleaned and two months after the incident, he found and extracted the blood stains left on the scene. He also told Deng Shiping's old mother that he would send blood samples for testing.

When Deng Shuisheng was in elementary school, Deng Shiping's mother was his teacher. Therefore, Deng Shiping's family trusted him.

Not long after the blood stains were taken, Deng Shuisheng's attitude changed-Huang Bingsong asked him to find him.

The court heard that after Huang Bingsong learned that Deng Shuisheng had found blood at the scene, he arranged for Yang Rongan, the office director of Xinhuang No. 1 Middle School, to find Deng Shuisheng through Cao Riquan and gave him cash of 20,000 yuan, and asked him to delay the blood stains for examination "Default" after receiving money. Since then, Deng Shuisheng has also received tobacco and alcohol from Huang Bingsong and others. In mid-May 2003, Huang Bingsong and Yang Rongan gave Deng Shuisheng 5,000 yuan in cash, asking him not to mention the excavation of the playground at the case analysis meeting.

During the investigation of Deng Shiping's case, Deng Shuisheng, the "leader" of the criminal investigation business, had an important influence on the analysis of the case. The team leader Cao Riquan also called it "master". Deng Shuisheng's leader Yang Xuejun said in the court trial that Deng's views at that time influenced his judgment on the merits of the case.

As a student of Deng Shiping's mother, Deng Shuisheng apparently failed the old man's trust in him. In May 2019, when the children of Deng Shiping submitted the accused materials to the Central Anti-gang Evil Steering Group, they also believed that Deng Shuisheng was only under external pressure that year.

Of the 10 "protected umbrellas" sentenced, Yang Xuewen, deputy director of the Huaihua Public Security Bureau, and Jiang Aiguo, director of the Xinhuang County Public Security Bureau, were sentenced to nine and seven years in prison by the court of first instance for negligence of duty.

Of the 10 public officials involved in the case, only Huang Bingsong and Yang Rongan were non-public security personnel. Both of them were found by the court to be accomplices of Yang Jun's favoritism.

Yang Rongan, who worked for Huang Bingsong's "before and after the saddle", was then the director of the office of Xinhuang No.1 Middle School. According to his later confession, Du Shaoping gave him 10,000 yuan when he contracted the Xinhuang Yizhong Track and Field Project.

Yang Rongan ’s wife, Long Shenglan, was 35 years old when Deng Shiping “disappeared”, and was the deputy head of education in Xinhuang County. Through the coordination of Long Shenglan, Huang Bingsong won the support of Wang Xingshui, then Secretary of the Xinhuang County Party Committee, Zhang Jiamao, Deputy Secretary of the County Party Committee, and Yang Qinglin, Secretary of the Political and Law Committee of the County Party Committee, on the issue of refusing to dig the playground.

In the Deng Shiping case that year, Yang Xuewen, deputy director of the Huaihua Municipal Public Security Bureau, was directly commanded and had the "supreme chief at the scene". How to "fight" the public security leader? Huang Bingsong invited another "advanced person" to come forward-Wu Shaokun, who was then the inspector general of the People's Procuratorate of Huaihua City.

Wu Shaokun is also from Xinhuang. He once served as vice principal at Xinhuang No. 1 Middle School and was an old colleague with Huang Bingsong. After accepting Huang Bingsong ’s request, in May 2003, Wu Shaokun came forward twice to organize a dinner, and invited Huaihua City Public Security Bureau Director Wang Hua and Deputy Director Yang Xuewen to eat with Huang Bingsong. At the dinner table, Yang Xuewen and others agreed not to dig the playground.

The list of public officials later subject to disciplinary and administrative sanctions also included Tian Daiwu, the deputy director of the Hunan Provincial Committee for Civil Affairs who had been "greeted". Tian is the old leader of Huang Bingsong and was the secretary of Xinhuang County Party Committee.

In the Deng Shiping case, a total of 19 public officials were involved in negligence and dereliction of duty. At present, 10 people have been sentenced to first instance and 9 people have been punished by party discipline and government affairs. Among them are many officials who have been in important positions, such as Wang Xingshui, former member of the Huaihua Municipal Party Committee and secretary of the Municipal Committee before the investigation, Wu Shaokun, former deputy mayor of Huaihua City, and Wang Hua, deputy inspector of the Hunan Provincial Public Security Department.

In the anti-crime operation in 2019, the case of Deng Shiping was finally settled after being supervised by the central supervision group and investigated by the judicial organs of Hunan.
