In a letter sent to Minister of Justice Nicole Belloubet on Friday and made public on Monday, they deplore the fact that the provisions of the March 25 order "were taken, once again, in the context of a repressive arbitration to the detriment individual liberties and the effective exercise of the rights of defense ”.

No appointment of lawyers in police custody

The president of the bar Serge Deygas specifies that the Lyon bar will not participate "in the appointment of lawyers in police custody for the holding of interviews or hearings known as" intangible "and which obviously do not respect the rights elements of the defense of respondents or victims ”.

The Keeper of the Seals presented several exceptional measures for justice on Wednesday as part of the state of health emergency, intended to "simplify" the procedures and allow the release of "5,000 to 6,000" detainees.

Among the derogations from the provisions of the Code of Criminal Procedure, article 13 of the ordinance provides that a person held in police custody or heard may interview a lawyer, or be assisted by him, from a distance, "by the through an electronic means of communication, including by telephone, under conditions guaranteeing the confidentiality of exchanges ”.
