Justice ruled in early March on the appeal brought by Vinci Construction Terrassement and two of its employees, after the judgment rendered against them in 2018. The company had been found guilty of “undermining the equality of candidates in public markets ”as part of the work to drain the Vezins dam (Manche), reports La Gazette Thursday, March 26.

The construction company was then fined 300,000 euros. The courts considered that a manager of the company had received elements allowing him to be favored during the invitation to tender. These data came from an employee of the project manager, who previously worked at Vinci.

A 25 million euros project

The group was given the task of 25 million euros for the dam. But at the time of the award of the contract, the prefect of the Channel had questioned the regularity of the process and had seized the justice. Convicted, Vinci and his two executives did not contest the decision.

Their appeal related to a technical detail of the verdict. The Coutances (Manche) criminal court had then ruled out mentioning the conviction. Those convicted therefore did not fall under the automatic ban on being candidates for public contracts.

The lawyer for the defendants nevertheless feared that his clients could not compete for a public contract. By "pure precaution", he had therefore asked the court of appeal to grant a recovery to Vinci and the two employees, explains La Gazette . The Advocate General did not contest this request and it was accepted.
