The president of the Departmental Council of Nièvre, Alain Lassus (PS), denounced this Friday the "exorbitant constraints" imposed by the State for a return to 90 km / h, which lead the department to give it up.

"The constraints imposed by the State are exorbitant and call into question the initial will of the elected departmental officials to make the Nivernais benefit from this derogation from 80 km / h", lambasted Alain Lassus in a press release, citing high costs and a risk legal.

300 million euros needed

"The 450 km of roads concerned in the Nièvre would require an effort of more than 300 million euros by the Department, while its annual road budget amounts to 10 million euros, including engineering structures", a- he explained.

In addition, "the legal uncertainty that such a measure would weigh on elected officials in the event of an accident is properly unacceptable," he added, confirming the department's renunciation to increase speed on its roads.

"Give a systematically unfavorable opinion"

Elected officials of Nièvre, who had first considered increasing speed on certain sections before giving up "before the extremely strict conditions" of the law on mobility, were waiting to receive the official framework for a possible return at 90 km / h.

A circular from the Ministry of the Interior, dated January 15, allows, at the request of the presidents of departmental councils, to derogate locally from the limitation of 80 km / h on two-way secondary roads without a central separator. Local elected representatives must justify their decision and respect certain conditions before making such a decision.

Considering that the road sections concerned must be "at least 10 km", the circular asks the prefects to "give a systematically unfavorable opinion" on the sections where there are "public transport stops", traffic agricultural and local machines, or "crossed by long-distance hiking trails or cycle routes" (medium or long distance cycle paths).
