The National Assembly unanimously adopted this Wednesday a LREM bill which aims to better "protect victims of domestic violence" and should allow the lifting of medical confidentiality in case of "immediate danger".

After two days of debate, the text, which aims to be the legislative translation of the "Grenelle against domestic violence" of the autumn, was voted at first reading by 55 votes, the possibility of reporting to justice by the doctor still arouses reluctance. The lifting of medical confidentiality will be possible for a health professional "when it appears to him" that violence within a couple "puts the life of the adult victim in immediate danger and that he is in the grip of their author ”.

Fight against conjugal cyberviolence

During the debates, in the presence of three members of the government - Nicole Belloubet (Justice), Marlène Schiappa (Equality between women and men) and Adrien Taquet (Child protection) - elected officials from both the right and the left pointed out the risk of 'a "loss of confidence" between the victim and his doctor. The elected majority Maud Petit (MoDem) also warned of a risk of “harmful consequences”, pleading in vain like PCF or PS to remove the measure.

Marlène Schiappa defended for her part a "useful" provision which emanates from the "Grenelle" and "comes from the women themselves", the rapporteur Bérangère Couillard (LREM) adding that it is the fruit of consultation with the Order doctors.

The text also represses the geolocation of a person without his consent, and creates an aggravating circumstance in the event of violation of the secrecy of correspondence by a spouse or ex-spouse, to better fight against "conjugal cyberviolence". In addition to these measures, the bill increases the penalties for harassment within the couple, bringing them to ten years' imprisonment when the harassment led the victim to commit suicide or to attempt suicide.
