Claiming to be victims of vertigo, headaches and feeling oppressed, Christel and Luc Fockaert had to move in 2015 from their home in Fontrieu, in the Tarn, eleven years after their arrival. According to this Belgian couple, their ailments were directly linked to the presence of six wind turbines near their home, one of which was 700 meters from their home, as authorized by the regulations.

Troubles after the cutting, two years earlier, of a wood, shielding their house from the wind farm. They had therefore filed an appeal to recognize an "abnormal neighborhood disorder" and a claim for compensation of some 350,000 euros to the operator 3D Energies.

This Thursday, they were dismissed by the court of Castres which indicated that "the causal link between the alleged disturbances and the operation of the park was not demonstrated," said Alice Terrasse, their lawyer.

Possible appeal

During the civil hearing on November 29, she cited two expert reports, one medical, the other sound level, to demonstrate that the "park is a source of nuisance".

The defender of the company 3D Energies, Alexandre Brugière, had for his part produced two reports from the Academy of Medicine and the National Environment Agency indicating that today “it cannot be established links infrasound and disturbances often invoked by applicants to characterize malaise ”.

The couple are thinking about appealing according to their lawyer.
