His Highness Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, in his capacity as Chairman of the Dubai Sports Council, issued Resolution No. (1) for the year 2020 regarding the governance of sports clubs in the Emirate of Dubai, with the aim of subjecting them to the foundations, rules and principles of governance, in accordance with the best global practices applied in this regard, To create sound practices for the work of sports clubs in a stable and balanced manner, in line with global regulations and the requirements of local, regional and international sports organizations and federations, to create a clear and specific format for the management of sports clubs, and to standardize rules and regulations related to their functioning.
The decision, whose provisions are applied to sports clubs that are determined by a decision of the President of the Dubai Sports Council, aims to ensure that sports clubs achieve the goals for which they were established, and enhance their role in serving the community and its various groups, and promote the principles of integrity, transparency, disclosure and accountability, and develop the self-resources of sports clubs Among the available resources and their investment, to achieve self-sufficiency, in addition to enhancing the professional performance of sports clubs, and ensuring the development of their technical and administrative cadres.
The decision detailed the tasks and powers of the Dubai Sports Council, including: adopting the basic system and the organizational, administrative and financial regulations of the sports club, including its organizational structures, adopting its own policies and following up on their implementation, as well as approving the general budget of the sports club and its final account, in accordance with the terms and criteria approved in this regard, And financial and administrative supervision and control of sports clubs and their employees, and agreeing to establish branches within and outside the emirate at the request of the head of the sports club. The decision also specified the organizational structure of the sports club, and the powers of its president , The system for forming its board of directors, its competencies, and the duties and responsibilities of the president and members of the board of directors of the sports club.
The decision regulated the conditions for membership of the Sports Clubs Board of Directors, as the member is required to be a citizen of the United Arab Emirates, and is active, scientifically, administratively and sportsly qualified, provided that the member is not less than (21) Gregorian years, and that he is of good conduct and behavior.
For the purposes of ensuring that the chairman and members of the sports club board carry out their duties as intended, none of them is prohibited: combining the presidency or membership of more than one sports club’s board, or combining the membership of the Dubai Sports Council and the sports club’s board of directors, or combining the membership of the sports club’s board of directors And he made the position of the club’s CEO, or any other position in his executive, until after obtaining the approval of the Dubai Sports Council, and the decision also specified the obligations of the sports club regarding the regulation of mechanisms to attract players and coaches.
The decision obliged the chairman and members of the board of directors, the CEO, the employees of the sports club, the players and the coaches, with the principles of disclosure and transparency, including enabling the Dubai Sports Council to view the information and data that must be submitted to or required by it in full transparency, including financial statements and internal audit reports, Any agreements or contracts that have a financial impact, concluded by the sports club with others, provided that a decision is issued by the Dubai Sports Council with the minimum data and information that must be disclosed.
The decision also obliged them to provide the Dubai Sports Council with details of the revenues earned by the sports club, including details of sponsorships, direct and indirect government support, support for the head of the sports club, revenues from tournaments, and any other gifts or donations received to the sports club, provided that the disclosure should be in the form of Clear, explicit, not misleading and timely, in a systematic and accurate manner, and that is done in accordance with the evidence approved by the Dubai Sports Council in this regard, and not to accept any material support, gifts, gifts or benefits without disclosing them to the Dubai Sports Council, with the exception of the player or trainer who is Embedding ar D signed between him and the sports club otherwise, and sign a pledge to ensure confidentiality and non-disclosure of information approved by the Dubai Sports Council in this regard.
According to the decision, the chairperson or member loses his representation on the sports club’s board of directors, in a number of cases: death, loss of eligibility due to any of the symptoms of legally established eligibility, or the inability to perform his duties, according to a report issued by the competent health authority Their membership shall also be terminated in cases: written resignation, subject to approval of the president of the sports club, or conviction by a judicial ruling of a felony or crime against honor or trust, or the number of absences from attending the sports club’s board of directors exceeds the limit stipulated in the internal system of the council Management, or replace one of them by a decision issued by the Dubai Sports Council based on the requirements of the general interest and the interest of sports club, and after coordination with the President of the Sports Club.
Sports clubs subject to the provisions of this resolution must reconcile their conditions in accordance with its provisions, within a time limit not exceeding six months from the date of its implementation, and the Chairman of Dubai Sports Council may extend this time limit for one time. The President of the Dubai Sports Council, or whoever he delegates to him, shall issue the necessary decisions to implement the provisions of this resolution, and any text in any other decision shall be canceled to the extent that it contradicts its provisions, and it shall be published in the Official Gazette, and it shall be enforced from the date of its publication.
