Despite what Carmen Calvo and Dolores Delgado say, the most important thing that happened in October for Spanish democracy is not the exhumation of Franco, but the sentence of the process . Mind you, the Minister of Justice believes that "exhuming Franco is the biggest victory of democracy in the last 40 years." As if the Constitution that gives rise to this exhumation or the defeat of ETA, to give two examples in which we all agree, would have been nothing more than small events in the daily evolution.

But what we are going to. The sentence of the process . The first thing that occurs to me is that this is a victory for democracy, because the Supreme Court makes it clear that what the convicted and fled independence leaders did was to skip the law : the Constitution and the Statute of Catalonia. It is so clear - and that was how it came - that since those events of September and October 2017, not a single political or social separatist has moved a single finger to disobey the legislation. Declarations there have been many and of all colors. Facts that could give rise to crimes, none. Neither Torra, nor Torrent, nor the different advisors nor those responsible for the ANC, of ​​Òmnium Cultural and others, have thought to contravene the law in the least. Only the detention of the members of the CDRs that had material to make explosives has broken this reality.

As I am a layman in criminal law, I am not in a position to judge whether the crimes of sedition and embezzlement are those that correspond to these offenders , or should have been convicted of rebellion. I do not know if the violence of those days was enough to raise the cataloging of the crime and, therefore, the penalty. But common sense tells me that between Tejero - taking the Congress and holding the deputies hostage for one night - and Miláns del Bosch - taking out the battle tanks for Valencia - and not letting an official from an official building leave - with this fact being serious - there is a certain difference in what refers to violence. Tejero and Milans were convicted of rebellion.

No one doubts that the trial for the process has been absolutely guarantee against the accused. And the work of the court during the oral sessions was exemplary from the point of view of procedural law. Something, by the way, recognized by all. Let's give the sentence its value: the rule of law has weapons to defend itself against the most powerful attacks . Let's see, if not, if in Catalonia the events of two years ago are repeated in the future. @vicentelozan
