The Constitutional Court has admitted to processing this Monday the appeal for protection presented by the PP deputy and former parliamentary party spokesperson, Cayetana Álvarez de Toledo, against the decision of the president of the Congress of Deputies, Meritxell Batet, who ordered the withdrawal of the daily of sessions of the Lower House the term "terrorist" referring to the father of the Vice President of the Government Pablo Iglesias.

According to legal sources inform EL MUNDO, the Second Chamber has agreed to study the amparo appeal presented given the constitutional significance of the question raised, which affects both freedom of expression and parliamentary law.

In addition, the magistrates of the Second Chamber of the High Court will promote that the appeal be fully addressed, since it is a new matter on which there are few doctrinal precedents.

On May 27, Álvarez de Toledo responded to Iglesias in the Chamber of the Lower House in the following way when the leader of Podemos alluded to his aristocratic profile: "You have made reference to my title of Marchioness, the social class, the aristocracy, over and over again, ultimately, right? As you know, children are not responsible for our parents, not even parents are fully responsible for what our children are going to be. That's why I'm going to tell you for the first and last time. You are the son of a terrorist. You belong to that aristocracy, to that of political crime. "

Batet decided to remove the expression "son of a terrorist" from the journal of sessions, relying on article 104.3 of the Chamber's regulations.

The transcription that appears in Congress is the following: "You [are the son of a terrorist]" with the corresponding footnote specifying that they are "words withdrawn by the president in accordance with article 104.3 of the House Rules ".

The Regulation contemplates the withdrawal of expressions "when they utter words or render offensive concepts to the decorum of the Chamber or its members, the State Institutions or any other person or entity"

The PP refused to pay the cost of the amparo claim - the 15,730 euros that it cost Álvarez de Toledo to appeal to the Constitutional Court - considering that it is a matter with which the party leadership did not even agree .

It was the Free and Equal platform that carried out a collection to pay for the filing of the appeal by the popular deputy.
