9. The case of Li Moumou and others in Yinchuan City, Ningxia Hui Autonomous Region suspected of illegally dumping waste oil sludge to pollute the environment

  At 23:00 on June 2, 2021, the Lingwu Branch of the Yinchuan City Ecological Environment Bureau of Ningxia Hui Autonomous Region (hereinafter referred to as the Lingwu Ecological Environment Branch) received a report from the public that a vehicle was illegally dumped on a deserted sandy land in Majiatan Town, Lingwu City. Waste oil sludge.

The Lingwu Ecology and Environment Branch immediately rushed to the scene with the law enforcement officers of the Majiatan Town Police Station in Lingwu City to inspect the site. At about 3:00 a.m. on June 3, they found a waste oil and sludge dumping point with a pungent odor.

  On the morning of June 3, in order to further find out the situation of the dumping site, the law enforcement officers of Lingwu Ecological Environment Branch and the staff of Majiatan Town and Lingwu City Public Security Bureau rushed to the scene again to investigate and found that the dumped object was more than 90 tons of black viscous liquid , covers an area of ​​about 100 square meters.

Lingwu Ecological Environment Branch immediately reported the case to the Yinchuan Municipal Public Security Bureau, and reported the situation to the Lingwu Municipal Government and the Yinchuan Municipal Ecological Environment Bureau.

  After investigation, the dumping material came from waste sludge produced by Ningxia Huaping Kerui Energy Chemical Co., Ltd.

On May 30, 2021, Li Moumou, the company's deputy general manager, signed an agreement with Zhang Moujia on behalf of the company, stipulating that Zhang Moujia leased the company's oil tank and cleaned the deposits in the tank.

From June 1 to 2, 2021, under the leadership of Zhang Moujia and Zhang Mouyi, Guo Moumou and other 4 people drove a vehicle to dump a total of 98 tons of sludge in Majiatan Town, Lingwu City.

The dumped sludge was identified as hazardous waste.

  In order to avoid the further spread of pollution, Lingwu Municipal Government, Lingwu Ecological Environment Bureau and Lingwu City Public Security Bureau immediately carried out emergency transfer and disposal work, and a total of more than 150 tons of waste sludge and contaminated soil were removed and disposed of on site.

After the incident, Ningxia Huaping Kerui Energy Chemical Co., Ltd. and Li Moumou respectively assumed the cost of emergency disposal of hazardous waste of 200,000 yuan and 120,000 yuan.

  1. Punishment

  In accordance with Article 338 of the Criminal Law of the People's Republic of China and the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Environmental Pollution Criminal Cases, the Lingwu Ecological Environment Sub-bureau Transfer the clues of the case to the Yinchuan Public Security Bureau.

On February 18, 2022, the Yinchuan Railway Transportation Court publicly announced that the defendant unit, Ningxia Huaping Kerui Energy and Chemical Co., Ltd., was sentenced to a fine of 120,000 yuan, and the principal offenders Li Moumou and Zhang Moujia were sentenced to 2 years and 1 year in prison respectively. 10 months, and a fine of 20,000 yuan; the remaining 6 accomplices were sentenced to fixed-term imprisonment ranging from 1 year, 6 months to 9 months, with suspended sentences and fines ranging from 20,000 to 5,000 yuan.

At the same time, the Yinchuan Railway Transportation Court issued "injunctions" to the six accomplices who were subject to probation, prohibiting them from engaging in business activities related to the disposal of hazardous wastes during the probation period of probation.

  During the trial of the case, the public interest litigation plaintiff, Yinchuan Railway Transportation Procuratorate, filed an incidental civil public interest lawsuit with the Yinchuan Railway Transportation Court. After mediation by the case handler, Ningxia Huaping Kerui Energy Chemical Co., Ltd., Zhang Moujia and others all voluntarily paid ecological fees. Repair costs, the purpose of the public interest litigation plaintiff was achieved, and the public interest litigation was withdrawn.
