The reporter learned from the Supreme People’s Court today that the “Decision of the Supreme People’s Court on Amending the Interpretation of the Supreme People’s Court on Several Issues Concerning the Applicable Law for the Trial of Personal Injury Compensation Cases (Draft for Solicitation of Comments)” has been publicly solicited opinions from the public. The deadline for soliciting opinions is December 10, 2021.
It is understood that the "Opinions of the Central Committee of the Communist Party of China and the State Council on Establishing and Improving the Urban-Rural Integrated Development System, Mechanism and Policy System" published on April 15, 2019 clearly put forward the requirements of "reform the personal injury compensation system and unify the compensation standards for urban and rural residents."
On September 2, 2019, the Supreme People's Court issued the "Notice on Authorizing the Pilot Program for the Unified Urban and Rural Compensation Standards for Personal Injury", authorizing the higher people's courts to carry out the pilot work of unifying the compensation standards for urban and rural residents in cases of personal injury compensation disputes in their jurisdictions.
In order to further implement the central decision and deployment, the Supreme People's Court plans to amend the "Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Personal Injury Compensation Cases" on the urban and rural distinctions of disability compensation, death compensation and dependents' living expenses compensation standards.
In order to further improve the judicial interpretation and better protect the health and safety of the people, the Supreme People's Court publicly solicits opinions from the society and welcomes people from all walks of life to actively provide valuable opinions.
