Münster (dpa / lnw) - Yazidis in northern Iraq in the Sindschar district have no general right to recognition as refugees in North Rhine-Westphalia.
They are currently not threatened with persecution as a group by the “Islamic State” (IS), the North Rhine-Westphalia Higher Administrative Court decided on Monday in two asylum procedures.
A 19-year-old Jesidin, who currently lives in Solingen, and a 23-year-old from Mülheim (Ref .: A 1489 / 20.A and 9 A 570 / 20.A) had sued.
The ISIS was militarily defeated and has since continued to be active as a terrorist organization - but not to the extent that every Yazidis in the region is threatened with persecution, the court justified its decision.
The plaintiffs had not asserted any personal risk.
The administrative court in Düsseldorf had previously recognized refugee status.
Whether the plaintiffs enjoy protection from deportation from Germany regardless of the general decision must be decided on a case-by-case basis, the court said.
The Federal Office for Migration and Refugees has already granted protection to the 19-year-old.
In the case of the 23-year-old, the court denied protection from deportation.
He could seek protection in the Kurdistan Autonomous Region in the north of the country.
The humanitarian situation there is not in violation of human rights.
