At the beginning of March, a figure skating coach in Solna was convicted of mental abuse and weighting against the then 15-year-old national team skater Selma Ihr. The decision was made by the Swedish Figure Skating Association's Ethics and Discipline Committee. But the coach chose to appeal to RIN - who freed the coach.

The decision stated that Ihr's parents had also appealed for a stricter penalty, but it came in too late and therefore RIN only assessed the coach's appeal and the parents' opinion.

- We can only test what the coach has stated, and it is just like in a normal criminal case in a normal court. If only the accused complains, the prosecutor can not come and add new aspects to things. Without in this case, we have only examined what the complainant has stated. That is within the framework of what we can do, says the Swedish Sports Commission's chairman Krister Malmsten and continues:

- For this reason, there will be a limitation in the examination and not in the whole case as it appeared in the Swedish figure skating community's ethics and disciplinary committee. Now it is only limited to the parts that were presented by the coach.

There were no restrictions

Could it have been a different outcome if the appeal came on time?

- Yes, had we been allowed to try the whole case then there would have been no restrictions. So purely hypothetically it could have ended differently.

In the statement to RIN, the girl's parents write that they were advised by the Sports Federation's Sports Ombudsman that they themselves did not have to make an appeal for a penalty, but that the coach's appeal opened for a retrial of the entire case.

"Based on this advice from RF's Sports Ombudsman, we have refrained from appealing," the parents write in the opinion.

SVT Sport has sought the Sports Ombudsman, but RF announces that they do not comment on what is said in the interviews during the investigation.

Did not proceed

Selma Ihr told SVT Sport after the message that she was disappointed that RIN did not hear witnesses she had called.

- We had careful discussions about it. The act consists of nearly 700 pages, and when we discussed that issue, we agreed that the material that was available was so plentiful that in addition to having oral hearings about the same things would not add anything. That's why we made that decision, ”says Krister Malmsten.

Although RIN freed the coach, the decision states that the rider appears credible and that the audio files support her.

- But with the rules of evidence that apply, just like in the general court, we do not believe that beyond all reasonable doubt that the information as a whole is accurate and in some parts not precise. However, we have not questioned the girl's credibility per se, says Krister Malmsten.

What is it that makes it not beyond all reasonable doubt?

- We have made an assessment as to the probability, and then you have to come up on a certain level. We agreed in the committee that one has not reached the level to trap the person in question.
