Where establishments, e-commerce platform companies, and takeaway companies use plastic bags and other disposable plastic products, they should report the use and recycling to the competent commercial department in accordance with the "Measures."

  Article 1 In order to protect the environment, save resources, promote the construction of ecological civilization, and guide enterprises and consumers to reduce and replace the use of plastic bags and other disposable plastic products, in accordance with the Law of the People’s Republic of China on the Prevention and Control of Solid Waste Pollution and the General Office of the Ministry of Commerce "Notice on Further Strengthening the Treatment of Plastic Pollution in the Commercial Field" (Shangban Circulation Han [2020] No. 306), formulates these measures.

  Article 2 The state encourages and guides the reduction of use and active recycling of disposable plastic products such as plastic bags, and promotes the application of alternative products that are recyclable, easy to recycle, and degradable.

  Article 3 Organizations of commodity retail establishments, e-commerce platform companies, and takeaway companies that use plastic bags and other disposable plastic products shall report the use and recycling of them to the competent commercial department in accordance with these Measures.

  Article 4 The Ministry of Commerce is responsible for guiding the reporting on the use and recycling of disposable plastic products by the establishment units of commodity retail establishments, e-commerce platform enterprises, and takeaway enterprises nationwide.

  Local commerce departments at or above the county level shall be responsible for reporting on the use and recycling of disposable plastic products by units of commodity retail establishments, e-commerce platform enterprises, and takeaway enterprises within their administrative regions.

  Article 5 The establishment of retail establishments, e-commerce platform enterprises, and takeaway enterprises shall report the use and recycling of disposable plastic products to the local county-level commerce department through the reporting system for the use and recycling of disposable plastic products.

  The Ministry of Commerce has established a national unified reporting system for the use and recycling of disposable plastic products to receive and process report information in a timely manner.

  Article 6 Organizations of commodity retail sites, e-commerce platform companies, and takeaway companies shall report the use and recycling of disposable plastic products in a timely manner, follow the principles of truthfulness, accuracy, and integrity, and shall not make false reports or major omissions.

  Article 7 The term "commodity retail places" mentioned in these Measures refers to various supermarkets, shopping malls and bazaars that provide retail services to consumers.

  Article 8 The term “e-commerce platform enterprise” as mentioned in these Measures refers to an enterprise that provides services such as online business premises, transaction matching, and information release for both parties or multiple parties in e-commerce for the parties or multiple parties to independently carry out transaction activities.

  Article 9 The “take-away enterprises” mentioned in these Measures refer to retail and catering enterprises that provide take-out services through e-commerce platforms.

  Article 10 The “disposable plastic products” referred to in these Measures include non-degradable plastic shopping bags, continuous roll bags, plastic packaging bags (including woven bags), non-degradable disposable plastic lunch boxes, plastic tableware (knives, forks, spoons), Plastic straws.

  The refinement standards for disposable plastic products are regulated by relevant national regulations, and the scope of disposable plastic products is dynamically adjusted according to relevant national regulations.

  Article 11 The organizer of a commodity retail site shall report on the use of non-degradable plastic shopping bags, continuous roll bags and the recycling of plastic waste.

  Article 12 E-commerce platform companies report the use of non-degradable plastic packaging bags (including woven bags) and the recycling of plastic waste generated by their own business, and strengthen the promotion of the reduction and substitution of disposable plastic products by operators on the platform guide.

  E-commerce platform enterprises conduct overall assessments of the use and recycling of disposable plastic products by operators on the platform according to the reporting period, and report to the local county-level commerce department.

  The overall assessment report includes, but is not limited to, platform rules formulated by platform companies to reduce and replace the use of disposable plastic products, relevant governance measures adopted, publicity and promotion activities carried out, and investigations on the use and recycling of disposable plastic products by operators on the platform , The reduction effect achieved, etc.

  Article 13 Take-out companies report the use of non-degradable plastic shopping bags, plastic lunch boxes, plastic tableware (knives, forks, spoons), plastic straws, and plastic waste recycling.

  Where a retail enterprise provides takeaway services, the report shall be consolidated in accordance with Article 11 and the preceding paragraph of this article.

  Article 14: Encourage retail establishments, e-commerce platform companies, and takeaway companies to report on the use of environmentally friendly alternative products.

  The environmentally friendly alternative products referred to in these Measures include paper bags, recyclable cloth bags, baskets, and degradable plastic products.

Among them, degradable plastic products refer to shopping bags, packaging films, lunch boxes, tableware, etc. that are made from degradable plastics and meet relevant national standards.

Biodegradable plastic shopping bags and biodegradable disposable tableware shall meet the requirements of GB/T38082 and GB/T18006.3 respectively.

  Article 15 In order to connect the supply and demand of environmentally friendly alternative products, suppliers of environmentally friendly alternative products are encouraged to report the production and sales of degradable plastic raw materials, degradable plastic products and other environmentally friendly alternative products in accordance with the provisions of these Measures.

  Article 16 For e-commerce platform enterprises, cross-regional commodity retail establishments, and takeaway enterprises, the headquarters of the enterprise shall report the overall situation to the local county-level commerce authority, and the reported information shall be shared in the place where it operates.

  Article 17 The reporting period of these Measures is half a year, and the initial reporting period is from July 1, 2020 to December 31, 2020. The report of market entities shall be completed within 30 days after the end of the reporting period.

  Article 18 The competent commercial departments at all levels shall layer their responsibilities, strengthen organization and implementation, publicity and guidance, and report information quality review, etc., and gradually realize that the main body of the report should report due to the law, and the overall situation of the report implementation will be completed at the end of the report. Report to the next-level competent commercial authority within 30 days.

  Article 19 The competent commercial departments at all levels shall strengthen the application of the report results, do a good job in the analysis of the use and recycling of disposable plastic products according to the reports of market entities, and report the analysis to the competent commercial department at a higher level within 30 days after the completion of the report.

  Article 20 The report situation can be used as a reference basis for government departments to implement support policies.

If the reported information does not comply with the national regulations on prohibiting and restricting the use of non-degradable plastic bags and other disposable plastic products, or failing to report in accordance with these Measures, the department designated by the local people’s government at or above the county level to undertake business law enforcement duties shall deal with it promptly Or be punished accordingly.

  Article 21 The Ministry of Commerce of the People's Republic of China is responsible for the interpretation of these Measures.

  Article 22 These Measures shall be implemented 30 days after the date of promulgation.
