According to reports, the case was reviewed by the First Criminal Division of the Seoul High Court. The independent prosecution team pointed out in the sentencing debate that the political and business relationship between Lee Jae-yong and Park Geun-hye is obvious.
After the Supreme Court’s all-member consensus judged that Li Zairong’s active bribery was established, he still insisted on passive bribery and the sentencing trial based on the law-abiding surveillance system was dubious.
Li Zairong’s defense lawyer retorted that the prosecution’s request for an extension of the evaluation time was a deliberate delay.
The independent prosecution team emphasized that it is illegal to follow the “Three-Five Rule” of the chaebol who only sentenced the chaebol to three years’ imprisonment for five years.
According to previous reports, Lee Jae-yong was previously involved in the scandal of former South Korean President Park Geun-hye's "confidentiality in politics". He was accused of donating and bribery to a consortium controlled by Park Geun-hye's "best friend" Choi Sun-sil to obtain convenience for inheriting Samsung. He was prosecuted in February 2017.
In 2019, the Supreme Court of South Korea sent the case back for retrial.
It is understood that Li Zayong was sentenced to 5 years in prison in the first instance.
In the second instance, he was sentenced to 2 years and 6 months in prison, suspended for 4 years, and released.
According to South Korean media, the South Korean Supreme Court found that the amount of Li Zayong's bribery increased to more than 5 billion won (approximately RMB 29.51 million), and additional punishment is inevitable.
