The withdrawal of party membership for the Brandenburg state parliament member Andreas Kalbitz remains in place.
The Berlin regional court on Friday dismissed a lawsuit brought by the 49-year-old against the federal party, which had declared his party membership null and void almost two years ago.
In justification, the presiding judge Hans-Joachim Luhm Schier previously explained in a discussion that Kalbitz had concealed his one-year membership in the Republicans in Bavaria in his application for admission to the AfD.
Therefore, the declaration of consent to membership is lawfully contestable for fraudulent misrepresentation.
The federal arbitration court of the AfD, like the federal executive board before it, declared Kalbitz’s party membership null and void in the summer of 2020.
When he joined the party in 2013, he was accused of failing to disclose a previous membership in the now banned right-wing extremist German Youth Loyal to Homeland (HDJ) and in the Republicans between late 1993 and early 1994.
AfD boss Tino Chrupalla reacted with the words: “The Berlin district court decided in the Andreas Kalbitz case.
All members must accept this judgment.
It is now the task of the Federal Executive Committee to unite all legitimate tendencies behind the goals of our party.”
