The Hong Kong police freezes the property of Xu Zhifeng, a former member of the fugitive, and members of the financial sector: the injunction is issued by the court and has greater effect

[Global Times Comprehensive Report] Xu Zhifeng, a former member of the Legislative Council wanted by the Hong Kong police with multiple cases, is now in exile in Australia, and the High Court has issued a property injunction against him.

According to Hong Kong's "Oriental Daily" report on the 11th, Xu Zhifeng published the emails of the Hong Kong police on social platforms.

The police informed him that the Department of Justice applied to the High Court in accordance with Article 7 under Schedule 3 of Article 43 of the Hong Kong National Security Law to issue a property restraining order against him, his wife and mother, expressly prohibiting them from moving in person or through an agent from Hong Kong. Take any property in your name, sell, dispose of, or devalue any property in Hong Kong.

The order also lists all three of their accounts and their balances that had been frozen by HSBC, specifying that the injunction covers all deposits in the accounts.

Failure to comply with the order will result in a five-year prison term or a fine of HK$500,000.

Xu Zhifeng claimed that he and his family had already sold all their properties in Hong Kong and transferred all their properties to other places, and this property injunction has no substantial impact on them.

Chen Zhenying, a member of the financial industry, said that the injunction will serve as a model for the same crimes in the future, and the injunction issued by the court is more effective than the executive order that the bank generally receives from the police to freeze the account, mainly because it violates Hong Kong's national security It is a serious crime in France, and the court's agreement to issue an injunction represents sufficient evidence.

As for Xu's wife and mother, it is believed that there is evidence that Xu once handled assets through them.

Gong Jingyi, a practicing barrister, said that she believed that the National Security Office of the police had conducted a detailed investigation and had sufficient evidence; if Xu believed that he and his family were innocent, he should return to Hong Kong to stand trial and defend himself, especially since his wife and mother were not wanted by the Hong Kong police at all. , can come back at any time, but obviously they know their fault.

Fu Jianci, vice-chairman of the Hong Kong Law Exchange Foundation and professor of law, reminded that whether it is Xu's family or others, as long as they assist in the transfer of their suspected black gold assets, they may also face the crime of money laundering, and if relevant persons know the purpose of black gold, including will endanger national security, then the person may be involved in the national security law and is legally an accomplice.

Xu Zhifeng was born in June 1982, a former member of the Legislative Council and a former member of the District Council.

In November 2020, he appeared in the District Court for a criminal case and was granted bail for retrial.

In December of the same year, Xu visited Denmark on official business, then announced his exile and quit the Democratic Party, and is currently in Australia.

The bank accounts of him and his family were frozen for a time, and the National Security Office of the Hong Kong police said at the time that he was suspected of money laundering or the proceeds of crime.

In June last year, Xu posted online that HSBC had frozen his account for more than half a year.

An HSBC spokesman said it does not comment on account-related matters, but all cases must comply with local laws and regulations.
