The Court of Appeal considered that only one of the accused men could be considered a trader and thus guilty of accounting offenses of the normal degree.
The other two believed that the Court of Appeal had more of the role of employees - and were completely acquitted on the point of bookkeeping violations.
The public prosecutor has now appealed the verdict and demands that all three be convicted of a serious accounting offense.
- In my opinion, it is important for the management of law enforcement that the Supreme Court clarifies how the criminal liability for accounting obligations should be determined when there are several people collaborating around a business subject to accounting, says Deputy Attorney General Katarina Johansson Welin in a press release.
In December, the three principals were sentenced to 1 year and 2 months in prison up to 3 years and 6 months.
Even then, it was clear that the verdict would probably be appealed.
