The municipality of Grenoble has filed an appeal with the Council of State after the suspension by the administrative court of the city of a controversial provision authorizing the wearing of the burkini in municipal swimming pools.

The appeal was filed Thursday, said a city spokeswoman.

The administrative court of Grenoble had ordered this suspension on May 25 after the filing by the prefect of Isère of a "secularism summary" which targets article 10 of the new regulations for swimming pools in Grenoble authorizing the use of swimsuits. burkini style.

The judges had considered that the article in question would allow users to “derogate from the general rule of the obligation to wear close-fitting outfits to allow certain users to free themselves from this rule for religious purposes”, and that its authors had thereby "seriously undermined the principle of public service neutrality".

The environmentalist mayor of Grenoble Eric Piolle immediately announced his intention to "appeal before the Council of State" after this suspension.

Interior Minister Gérald Darmanin, for his part, welcomed the suspension of the provision, describing it as “excellent news”.

The new swimming pool regulations, which opened the door to the burkini but also to topless swimming for women and anti-UV swimsuits for all, were adopted on May 16, by a narrow majority by the municipal council.

Some allies of the environmentalist mayor had disassociated themselves from the project, against the backdrop of a national political storm.

The rest of the text formally entered into force on June 1.

The summer opening of the municipal swimming pools of Grenoble is scheduled from June 13 to August 30.
