In the 1965's, a woman in her 70s and a husband in her 80s who lived in Kansai, who lived in Kansai for being forced to undergo sterilization based on the former Eugenics Protection Law, and a 70s who had intellectual disabilities due to the aftereffects of the disease. In a trial in which a total of three women sued the country, the Osaka High Court of the second trial said on February 22, "The old eugenics protection law is inhumane and violates the constitution." I ordered compensation of 27.5 million yen.
The state argued that the "exclusion period", in which the right to seek compensation after 20 years of tort has passed, has already passed, while the ruling "goes to information and consultation opportunities to file a proceeding. The exclusion period was not applied, such as "I was in an environment where access was extremely difficult."
According to the Ministry of Justice, as a result of discussions with the Ministry of Health, Labor and Welfare, etc., the decision was appealed to the Supreme Court on the 7th.
According to the plaintiffs' lawyers, nine courts nationwide have filed a lawsuit seeking compensation for sterilization under the former Eugenics Protection Act, but the government is liable for damages. It was the first time that the ruling admitted, and the focus was on whether the country would accept it.
