Federal Supreme Council refers 5 accused of drug trafficking to "appeal"

The Federal Supreme Court overturned a ruling that sentenced five accused of drug trafficking to life imprisonment and deportation from the state, decided to refer the case to the Court of Appeal for its consideration again, on the basis that one lawyer pleaded on behalf of the accused in the case despite the conflict of interest between them.

In the details, the Public Prosecution referred five defendants to trial on charges of possessing drugs with the intention of trafficking, in addition to charging four of them with drug abuse, demanding that they be punished in accordance with the Federal Law on Combating Narcotic Drugs and Psychotropic Substances, as amended, and the First Schedule.

The Court of First Instance ruled to punish the five defendants with life imprisonment for the charge of trafficking, and punish four of them with two years imprisonment and fine them 10,000 dirhams for the accusation of abuse, and deport the defendants after the execution of the sentence and confiscation of the seizures, then the Court of Appeal confirmed them, so four defendants challenged this ruling.

The defense of one of the defendants, lawyer Ali al-Abadi, said, "The ruling violated the law for allowing one lawyer to defend the third and fourth defendants, after each of them confessed against the other."

The Federal Supreme Court clarified that the verdict was based on the confession issued by the third and fourth defendants, and that the confession of each of them is considered evidence against the other, which is considered a conflict of interest. All defendants have one lawyer before the first and second courts, so the judgment is considered null and necessary to be overturned with the referral.
