A man in his 50s who installed an 'unlicensed' elevator in the house and failed to take safety measures and killed a friend on the elevator was sentenced to a fine in the appeals court following the first trial. 



The 2nd Criminal Division of the Jeonju District Court (Chief Judge Lee Young-ho) announced on the 28th that it maintained the original trial, which dismissed the defendant's appeal and sentenced a fine of 5 million won in the appeal of 59-year-old A, who was charged with manslaughter. 



Mr. A is accused of neglecting the safety management of the elevator installed in his house in Iksan-si, Jeollabuk-do around 9:30 pm on December 29 last year, and causing his friend B to die by being hit by the elevator. 



At that time, they decided to rest at Mr. A's house after drinking together.

However, when B found out that he had left his bag at the bar and went back to pick it up, each arrived at Mr. A's house separately. 



It is known that Mr. B, who was entering Mr. A's house alone, misunderstood the location of the elevator coming down from the second floor and suffered a bowel movement while under the elevator. 




As a result of the investigation, it was revealed that Mr. A installed an elevator in the house arbitrarily without permission 10 years ago, and did not display the minimum instructions or warnings about the elevator operation method or precautions. 



The first trial court ordered a fine of 5 million won, saying, "It is difficult to believe that the defendant, as the owner of the building and the elevator manager, took sufficient measures to prevent a safety accident from occurring."



In response, Mr. A appealed for reasons such as misunderstanding the facts and misunderstanding the law, saying, "The accident occurred due to the victim's wrong elevator operation. There is no negligence in relation to the victim's death, and it cannot be considered that the negligence was the cause of the victim's death."



However, the second trial court ruled that "the judgment of the lower court is correct that the defendant neglected his duty to prevent a safety accident and this resulted in the death of the victim."
