As a honoured student who graduated from Southwest University of Political Science and Law in 1991, Dao Wenbing was admitted to the Kunming Intermediate People's Court by "the best among the best".

After participating in the trial of many major cases, he became the backbone of the trial of the Kunming Intermediate Court.

  But 29 years later, the 51-year-old post judge Dao Wenbing stood opposite the trial bench.

  In September 2019, he was involved in an intentional homicide case. The deceased was a deputy director of the Judicial Technology Division of the Kunming Intermediate Court.

The Yuxi Procuratorate charged that the defendant Dao Wenbing was suspected of intentional homicide, cover-up and concealment of criminal proceeds, and illegal possession of ammunition.

On June 30 this year, the case was designated by the Yunnan Higher People's Court to be heard by the Yuxi Intermediate People's Court.

On the same day, the second plenary meeting of the 28th meeting of the Standing Committee of the 14th National People's Congress of Kunming voted to remove Dao Wenbing from the position of judge of the Kunming Intermediate People's Court.

  Earlier, some media reported that Dao Wenbing was detained for bribery handling cases of commutation and parole during his tenure in the Trial Supervision Division of the Kunming Intermediate Court.

While being detained, Dao Wenbing confessed that he committed the crime of intentional homicide.

  A reporter from the Beijing News learned that the police took Dao Wenbing away from the scene of the crime on the day of the incident.

An insider close to the court system said that after the police visited the scene, they found traces of fighting.

  A reporter from the Beijing News learned from authoritative channels that whether Dao Wenbing was suspected of embezzlement or bribery has not yet been confirmed and the supervision department is still investigating.

The "crime of concealing and concealing criminal proceeds" prosecuted by the Yuxi Procuratorate only means that Dao Wenbing conceals illegal gains for others, and does not mean that he himself is suspected of corruption or taking bribes.

  A spokesperson for the Yuxi Intermediate People's Court said that the opening time of the Dao Wenbing case has not been determined.

The court has received only the case of "Intentional Homicide, Cover-up, Concealment of Criminal Proceeds, and Crime of Illegal Ammunition" that the court has received so far. It does not involve crimes related to job-related crimes. As for whether follow-up will be followed, it is unclear.

Suspected of killing his girlfriend, there were signs of fighting at the scene

  Since last year, news of Dao Wenbing's killing has been circulating in the Kunming political and legal system.

"He is very sunny and capable. This is very sad." Dao Wenbing's university alumnus said.

  According to the public resume, Dao Wenbing was born in Kunming, Yunnan Province in July 1969, graduated from the Law Department of Southwest University of Political Science and Law in July 1991, and then joined the Kunming Intermediate People's Court.

Served as deputy chief of the Criminal Trial Division of Kunming Intermediate People's Court, deputy chief and judge of the trial supervision division of Kunming Intermediate People's Court.

  A person familiar with the matter told the Beijing News that it was his girlfriend who was suspected of killing Dao Wenbing, who was also a deputy director of the Judicial Technology Division of the Kunming Intermediate People's Court and was from Dali, Yunnan.

The deputy director was interviewed by the Supervisory Committee on suspicion of helping a deprived official of the Yunnan political and legal system conceal property.

After Dao Wenbing learned of this, he had a dispute with him and pushed him down from the 23rd floor.

  A reporter from the Beijing News visited and learned that the Dao Wenbing murder occurred at the end of September 2019.

The incident was located on the 23rd floor of a community near the Kunming Intermediate Court, a high-end community in the center of Kunming, with an average price of 19,000 yuan.

A reporter from the Beijing News inspected the same apartment at the place where the incident occurred and found that the apartment had an area of ​​about 91 square meters, two bedrooms and one living room.

After the incident, the house involved in the case was sealed by the local police station, the floor was closed, and security guards checked in regularly.

  According to nearby residents, on the morning of the incident, a woman fell from a height to the side of the road.

The police arrived and took a man away. The man kept his head and his forehead was slightly bald.

  According to the Beijing News reporter, the police took Dao Wenbing away from the scene of the crime on the day of the incident.

An insider close to the court system said that the police found traces of fighting after investigating the scene, so Dao Wenbing has not been released after taking him away.

  A person close to the public security system said that the deceased had kept his belongings for several officials before his death, and whether there was any connection between the Dao Wenbing and the aforementioned officials who had fallen in the political and legal system of Yunnan remains to be investigated.

  On June 30, 2020, the Yunnan Provincial Higher People’s Court issued a designated jurisdiction decision that mentioned that the defendant Dao Wenbing prosecuted by the Yuxi City People’s Procuratorate was suspected of intentional homicide, cover-up, concealment of criminal proceeds, and illegal possession of ammunition.

"Excellent selection" entered Kunming Intermediate Court

  In 1987, Dao Wenbing was admitted to the Southwest College of Political Science and Law.

This is one of the first batch of national key universities and the only key university among the political and law colleges under the Ministry of Justice. There are only more than 500 students in Dao Wenbing's grade.

  Dao Wenbing’s younger brother remembered that he was “not extreme at all, very calm, and would not easily express opinions on any matter.” During his time at school, Dao Wenbing was a member of the grade football team, “very handsome and very sunny”, in his memory In the middle, Dao Wenbing speaks humorously and likes to play the guitar. He is the "male god" in the eyes of schoolchildren.

At Sichuan International Studies University, Dao Wenbing met a girlfriend and later brought her to Kunming for marriage.

  In 1991, Dao Wenbing graduated from Southwest University of Political Science and Law and was assigned to the Kunming Intermediate People's Court.

Dao Wenbing alumni remember that there were about 23 people from Kunming during the Xizheng session, and only 4 went to the middle court. "It can be said that it is the best among the best."

  After entering the court, Dao Wenbing became the backbone of the trial, and was therefore more respected by the alumni circle.

According to reports, Dao Wenbing is also among the first batch of judges in Yunnan.

  The aforementioned alumni recalled that more than ten years ago, Dao Wenbing was sent to the Wuhua District Court as the vice president, and returned to the Kunming Intermediate Court in 2009.

In his opinion, serving in the district court was a signal for promotion, but it is not clear why the rank of Dao Wenbing did not change much later.

  There is a saying in Kunming's political and legal system that Dao Wenbing's development of female "specially related people" hindered her promotion, and this woman was the dead deputy director of the Judicial Technology Department.

  In 2018, Dao Wenbing was transferred to the Executive Board.

Some lawyers believe that Dao Wenbing's transition from the Criminal Court to the Executive Bureau has not changed much, but he has gradually divorced from the core trial business and has been marginalized in the court system.

Lawyer called his character domineering

  Dao Wenbing also participated in the trial of Sun Xiaoguo's case.

On February 18, 1998, the Kunming Intermediate People's Court heard the case of Sun Xiaoguo, convicted him of rape, forced insult to women, and intentional injury. He was punished for several crimes and decided to execute the death penalty, depriving him of political rights for life.

However, Sun Xiaoguo later escaped sanctions under the operation of his mother and stepfather.

  In 2004, the First Tribunal of Criminal Justice Long Dao Wenbing presided over a major case.

One year later, the Kunming Intermediate People's Court mentioned in its comment on awarding the team that "the court of first instance has a profound understanding of legal principles and criminal law provisions, which will have procedural and substantive guiding significance for the future courts of Kunming to try similar cases."

  A lawyer recalled that Dao Wenbing was a typical domineering character, "if he has a professional level, he is domineering."

  In a case handled by the lawyer many years ago, Dao Wenbing was the trial judge.

During the trial, the lawyer cross-examined the evidence from the prosecutor, "Wen Bing Dao, are you asleep in front of you?" At this time, an old lawyer from Yunnan said, "The presiding judge, if you don't want to listen to the lawyer, you can just go straight. The sentence will be fine." Dao Wenbing stopped interrupting after listening.

  Then, a lawyer from Hunan made a speech.

"Dao Wenbing said,'Don't say it, I don't understand it anyway, go back and write a defense', very domineering and dragging."

  There are also lawyers who remember that during his tenure in the Wuhua District Court, Dao Wenbing required lawyers to wear lawyer's gowns when they went to court.

"I feel he is asking for the right thing, so he wears a lawyer's gown every time he goes to court."

  16 years ago, in the judgment of a major case presided by Dao Wenbing, the Kunming Intermediate People’s Court wrote this paragraph: The right to life of citizens is the foundation of all rights. The law cherishes and protects the right to life of citizens and severely sanctions any disregard. The crime of the right to life of others.

  16 years later, Dao Wenbing, the former trial judge, also stood on the opposite side of the trial on suspicion of intentional homicide, cover-up, concealment of criminal proceeds, and illegal possession of ammunition.
