A nursing assistant from the CHU Gabriel-Montpied in Clermont-Ferrand (Puy-de-Dôme) was prosecuted by her establishment for "non-public defamation" after accusing a professor of medicine at the hospital of rape while the preliminary investigation open about him was still going on.

No intention to harm

For the court, the defendant's denunciation did not appear to be defamatory.

The nurse's aide would have acted sincerely by using the words "prudent and measured" without wanting to harm the doctor.

This declaration was also made in the workplace, which since the law of social modernization constitutes a protective space.

This judgment was welcomed by Me Marion Libert, the caregiver's lawyer.

She felt that it sent a “good signal” in the perspective of freedom of speech at work.

The professor has lodged an appeal in cassation.
