During the night of Sunday to Monday, the gendarmes arrested a driver who was driving without a license, near Nîmes, in the Gard. They had discovered that he was a man indicted for manslaughter after a fatal accident in 2017. He had lost control of his vehicle while driving beyond the authorized limit, according to the forensic expertise, and under the influence of narcotics.

His partner and two babies aged 6 and 18 months died in the accident. Just like a fourth passenger a few days later at the CHU of Nîmes. None of the passengers were attached, including the two children who did not have a suitable seat. The driver was driving without insurance or up-to-date technical control. Placed under judicial supervision, he no longer had the right to drive since then.

The lawyer pointed out a legal problem

The judge who tried him in direct appearance, Tuesday, raised a legal problem to decide the acquittal of the accused for the offense of driving without a license, as raised by lawyer Isabelle Mimran. The Nîmes public prosecutor's office immediately appealed this decision.

The fatal accident, the investigation of which has also ended, is the subject of a separate procedure. He will be tried later by the criminal court of Nîmes.
