Review of the case of Zhang Zhichao

  In January 2005, a high school girl from Linshu No. 2 Middle School disappeared. One month later, the body was found in an abandoned toilet in the school. Forensic identification revealed that the body was naked. The next day, Zhang Zhichao, a 15-year-old high school student, was taken away from his home by the police.

  In March 2006, the Linyi Intermediate People's Court found Zhang Zhichao's rape was convicted and sentenced to life imprisonment. Wang Guangchao of the same grade was charged with the crime of asylum and was sentenced to three years of probation and three years of execution. After the sentence was pronounced in the first instance, Zhang Zhichao did not appeal, but he filed a complaint five years after imprisonment, denying that he had done so.

  On December 28, 2017, the Supreme People's Court made a retrial decision, arguing that the facts of the case were unclear and that there was a contradiction between the main evidences, and instructed the Shandong High Court to form a collegial panel for retrial.

  On January 13 this year, Shandong High Court retriald Zhang Zhichao and Wang Guangchao innocent. On May 25, the "Zhang Zhichao Case" was also selected into the work report of the Supreme People's Court and the Supreme People's Procuratorate.

Apply for huge compensation

  The cover news reporter learned from Zhang Zhichao’s attorney that Zhang Zhichao applied for more than 7.8 million yuan in state compensation, including more than 1.8 million yuan in compensation for personal freedom violations and 6 million yuan for mental damage relief.   Zhang Zhichao’s lawyer said that according to statistics, Zhang Zhichao was detained from February 12, 2005, and was acquitted by the Shandong High Court on January 13, 2020, totaling 5449 days in custody. According to the compensation standard of 346.75 yuan per day announced by the Supreme People's Court on May 18, Zhang Zhichao applied for compensation for infringement of personal freedom of 188,9440.75 yuan.

  Regarding the mental damage relief fund, the lawyer said that in this case, Zhang Zhichao was sentenced to life imprisonment for rape, causing Zhang Zhichao’s reputation to be severely damaged, and his close relatives have also been suffering from mental damage and gossip in the neighborhood. Make up for the serious consequences. In addition, Zhang Zhichao’s father and many other relatives died during his sentence, causing serious mental harm to him.

  It is understood that in recent years, the amount of mental damage relief payments in national compensation for wrong cases has been increasing year by year. In 2013, the "Mr. Zhang's Nephew Case" mental injury relief payment was 900,000 yuan; in 2014, the "Hugh Gilles Pattern" mental injury relief payment was 1 million yuan; in 2016, the "Chen Man Case" mental injury relief payment was 900,000 yuan.   Zhang Zhichao’s mother Ma Yuping told reporters that Zhang Zhi’s physical condition has not been very good since he was released from prison. He has not eaten much, and is still as thin as when he was released from prison. Regarding his son's future, Ma Yuping said that after the state compensation is issued, he would like Zhang Zhichao to learn a craft and reintegrate into society.
