The case papers stated that the accused was accompanied by two of his friends in a car, one of them in the Palm Jumeirah area, when a police patrol monitored the driver's busyness on the road using a mobile phone, and his sudden deviation, so the policeman decided to stop him to warn him of his behavior, and issued a violation for him.

Meanwhile, the accused was sitting in the back seat, filming himself with his phone, and in the background the police patrol, and he made an obscene word. The policeman asked him why he was filming, and took him to the police station, after refusing to disclose the content of the filming and handing over the phone.

By questioning the accused in the investigations of the Public Prosecution and the police evidence report, he stated that he used his phone to photograph himself, while the patrol appeared in the background of the filming, and sent the video to his girlfriend.

The accused voluntarily turned on the phone, showed the clip that he filmed, and appeared to utter an obscene word.

After considering the case by the Criminal Court, it acquitted him of two other charges brought against him, and convicted him of the photographing incident, and fined him 50 thousand dirhams, and confiscated the phone.

In addition, the accused appealed the verdict before the Court of Appeal, and denied the accusation against him, requesting the annulment of the verdict and, in precaution, the use of clemency, while the Public Prosecution requested that the appeal be rejected and the verdict upheld.

After examining the case, the Court of Appeal confirmed its satisfaction with the conclusions of the case papers, based on the confession of the accused, as well as what was included in the forensic report after examining his phone, which are palatable evidence, which resulted in the confirmation of the first-degree fine.
