This is one of the options mentioned by the French government for the French women of jihadists now held in Syria by the Kurds: to transfer them to Iraq to try them there. Foreign Affairs Minister Jean-Yves Le Drian spoke about it on BFMTV on Wednesday. Opposing categorically to their repatriation to France, he felt that judging them in Iraq would be "a good opportunity". Marie Dosé, lawyer of several of the families of these women, strongly opposes it. "We are doing anything," she said on Europe 1 Wednesday.
"These women will end up with their children in Iraqi jails, where the Islamic State was born," said the lawyer. Which reminds that the Iraqi justice "tortures and condemns to death". Marie Dosé castigates the "populism" of Jean-Yves Le Drian. "Can you imagine today that a minister is clearly showing his preference between Iraqi justice and French counterterrorism?"
An international criminal court "not feasible"
The lawyer stressed that "these women are only judiciarized in France". "They are all under a French international arrest warrant, and the anti-terrorism judges are investigating what they have done there, which they have been doing in France for months, sometimes years." It is therefore much more logical, according to her, to repatriate women prisoners.
According to their families and lawyers, some 100 mothers and about 200 French children, three-quarters of whom are under the age of five, are being held in Syria. Finally, recalled Marie Dosé, "transfers of nationals from Syrian Kurdistan to Iraq are illegal." Jean-Yves Le Drian has already had to explain to the United Nations who have openly offended.
Another hypothesis has emerged: the creation of an international criminal court. But Maris Dosé, again, does not believe it. "No one believes in this hypothesis, it has already been mentioned, it will run up against international law and the veto of the US Do you realize how long it takes? extremely unstable, it's not feasible.
