His Highness Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai and Chairman of the Executive Council, issued Council Resolution No. (9) for the year 2020 to amend some provisions of Executive Council Resolution No. (11) for the year 2013 to issue the executive regulations of Law No. (11) for the year 2010 , Regarding licensing marine means in the Emirate of Dubai.

The decision obligated the owner of the marine vehicle, or the captain, to lead the marine vehicle and supervise its operation and management, as it specified the period of validity of the license for five years, and it may be renewed for similar periods. It is permissible for the Dubai Maritime Authority to withdraw the license for a period not exceeding six months or to cancel it.

The resolution provided for the replacement of articles, numbers: (1), (2), (3), (9), (12), (15), (23), (24), (29), (30), (33) (35) and (52) with new texts related to the scope of application, procedures for the issuance, renewal and amendment of the license granted to the marine means to sail in the waters of the Emirate, notification of the damage or the loss of the marine means, the permit of the visiting foreign marine means, and the conditions for granting the license to workers on the marine means, The period of validity of the license, its withdrawal or revocation, and training in the practice of marine activities.

Apply the decision

This decision applies to the marine means that sail in the waters of the Emirate of Dubai located between the borders of the Emirate of Sharjah and the Emirate of Abu Dhabi and extend to the exclusive economic zone, including the internal waters of the emirate, maritime ports, marinas, canals and waterways, and on the authorities and individuals who engage in any marine activity in the Emirate of Dubai related to the use of Maritime means, their command, guidance, or work on them, or training their crew, leasing, or transport by them or any other activity related to them, provided that they are exempt from the registration and licensing provisions determined by this resolution. King Dubai Maritime City and the authority of the armed forces, civil defense and Dubai Police, Navy and means registered and licensed outside Dubai, authorized to enter the emirate, and other marine means to be determined by the decision of the Chairman of the Executive Board.

Marine activities

Marine activities, according to the decision include: maritime transport, inspection of marine means, maritime safety, education and training in driving marine means, training in diving and water sports, and other marine activities that are authorized to be practiced in the emirate.

Sports and marine means

In accordance with the decision, the marine sport facilities designated for the practice of water sports include: water bicycles, robots, water vehicles, hovercraft, small electric boats, and small petroleum boats. As for the traditional marine wooden means made mainly of wood, they include: abras, floating wooden restaurants, Wooden wooden boats, and the like.

The loss of the marine vehicle

The decision included procedures for issuing, renewing and amending the license, explaining the documents and documents required for its completion, and cases of notification of the damage or the loss of the marine means, as the decision obligated in Article (23) the owner of the marine means, or the captain, who is the person authorized by the Dubai Maritime Authority to lead the marine means and supervise Upon its operation and management, it shall immediately notify the Authority of any malfunction or malfunction of the marine means or its equipment that may affect the safety of its passengers or its suitability to sail.

In the event that the marine vehicle is lost for any reason, or in the event it is lost or stolen, the owner of the marine vehicle or the master must immediately notify the Dubai Maritime City Authority, and return the original license to it if possible, so that the authority undertakes a technical investigation into the accident and prepares a report in this regard On the basis of which the maritime means are removed from the register and the license is revoked.

Visiting medium

Article (24) stipulates that the visiting foreign marine means shall be permitted to sail in the Emirate's waters for picnic purposes or for any other purpose, whenever they are rented by a party licensed to operate in Dubai, provided that this marine means obtains a permit to do so from the Dubai Maritime City Authority, and it is for a period of time This permit is six months renewable, in the event that the visiting foreign marine means will sail in the waters of the emirate for purposes of excursion, and six months are not renewable if the visiting foreign shipping method is rented.

Grant the license

The decision specified the conditions for granting the license to workers on the maritime means according to the type of each vehicle, as well as determining the validity period of the license for five years, and it may be renewed for similar periods, and the Dubai Maritime Authority may issue a license to drive or work on the maritime means for a period not exceeding three Months, according to the terms and requirements that are specified by a decision of the Executive Director of the Dubai Maritime City Authority in this regard, and the license issued in accordance with the provisions of this decision is considered canceled if it is not renewed within one year from the date of its expiry.

The Dubai Maritime City Authority may, in accordance with Article (33) of the decision, withdraw the license for a period not exceeding six months or revoke it, if the holder violates the provisions of the law on licensing maritime means in the Emirate of Dubai, and the person whose license was revoked or canceled must immediately surrender it to the authority.

According to the decision, no natural or legal person may train any person in any marine activity, unless he has been authorized by the Dubai Maritime City Authority.

Floating housing

In accordance with the new text of Article (52) of the Resolution, the Dubai Maritime City Authority, in coordination with the relevant government agencies in the Emirate, issues the necessary decisions and instructions to implement the provisions of the law and this decision.

The Dubai Maritime City Authority is also competent, in accordance with this Article, to issue decisions and instructions related to the regulation of floating housing facilities, which are used for residence in the waters of the Emirate, and include floating homes, hotels and restaurants, and the marine means designated for that.

The decision stipulated that the phrase “marine entertainment means” should be modified wherever it appears in the original decision, to be replaced by the phrase “marine excursion method”, and that tables (1) and (2) attached to the original decision No. (11) of 2013, concerned with determining fees, should be canceled. Concerning maritime means and the determination of violations and fines, respectively, to be replaced by the two new tables attached to this decision.

Marine facility

The new resolution defines the marine means as any means that travels in the waters of the Emirate of Dubai to transport passengers or goods, whether for personal, commercial, sporting or tourism purposes, whatever its type or form, as it defines the goods that are transported by the marine means in the Emirate of Dubai as any materials or Equipment or things, whether they are animal, agricultural, industrial, raw materials, or others, in liquid, solid or gaseous condition.

Commercial marine means

Article (3) of the Resolution, in its new text, divided the marine means that are registered and licensed by the Dubai Maritime City Authority into four categories, the first of which is the commercial marine means, which include: marine means for leasing, marine means operating in the ports of the Emirate of Dubai, and marine means used for construction purposes , Used for towing and piloting purposes, marine means for the carriage of passengers, and other means for carriage of goods.

Means for marine excursion

Marine excursions, which are designated for personal use, include: marine means used for excursion with an engine, including: marine means that are less than (12) meters in length, and whose length ranges from (12) to (24) meters, and whose length exceeds (24) meters , In addition to the marine means used for excursion without an engine, including: rowing boats, sailing boats and the like.
