就地过年权益不“打折”,企业要善用集体协商

  春节就要到来,许多家在异地的职工选择留在工作地过年,尽可能减少人员流动,同时,他们也对加班工资、调休等话题更加关注。不少企业推出暖心举措,保障就地过年员工的合法权益,弥补员工不能回家的遗憾。

  “过年还回家吗?”春节临近,疫情反复之下,是留在当地还是返回老家过年成了许多职场人绕不开的话题。近期,上海一项调查显示,出于防疫要求、返岗时间等多方面考虑,已有相当比例在上海工作的职工选择了留沪过年。

  《工人日报》记者在采访中了解到,有了之前留沪过年的经验,选择不返乡的职工普遍对春节期间的权益维护更为看重。他们期待各级工会和企业拿出切实举措,温暖留守的自己。

  关注1 加班费和调休该怎么算?

  纠结再三,在上海工作的佳佳还是退掉了年前回东北老家的飞机票,“最新的规定是回家要隔离14天,这样春节期间都出不去了,想想就当作为家乡人民降低风险了”。

  往年的春节,值班、加班这些事都与佳佳无关,可今年没有了返乡的计划,企业给她在节假日里安排了一定的工作,这让佳佳有了疑惑:“春节期间,加班工资和调休该怎么算?”

  涉及加班工资、新年红包、补贴的咨询,上海市总工会法律顾问、上海七方律师事务所主任李华平连日来收到不少。对此他给出了详尽解答:按照劳动合同法的规定,实行标准工时制的用人单位,如果在法定节假日安排劳动者加班的,用人单位支付的加班工资应当不低于日工资基数或者小时工资基数的300%;休息日加班则是200%的加班工资。

  以上海地区最低工资标准每月2590元计算,折算到21.75天的上班时间,每个工作日的日薪为119.08元,那么正月初一至初三每日工资应为357.24元,除夕、初四至初六则为每日至少238.16元。

  In this regard, Li Huaping suggested that enterprises can use the collective negotiation platform to negotiate with employees about work break and start time, formulate staggered vacations and scheduled vacation plans according to production work conditions and employees' wishes, and adopt rotational shifts, comprehensive adjustments to use rest days, and annual vacations. and welfare leave arrangements.

  "In terms of specific operations, the enterprise should issue a collective negotiation notice to all employees to inform all employees of the production and operation of the enterprise, so that employees can understand the difficulties of the enterprise and understand the practices of the enterprise."   在法律服务方面,上海市总工会会同该市司法局、律师协会共同开展“尊法守法 携手筑梦”服务农民工公益法律服务行动,重点面向以农民工为主体的新就业形态劳动者,聚焦拖欠劳动报酬等涉及农民工劳动保障权益的问题,组织引导社会律师、社会工作者和志愿者,广泛参与公益法律服务行动,更好维护劳动者的合法权益。

  同时,沪上许多企业积极回应职工诉求,准备了丰富多彩的节日活动,让留沪过年一样精彩。

  地处上海嘉定工业区的盈达空调公司今年不仅提前发放年终奖,还对留沪员工额外派发红包。节日期间的安排丰富多彩,既有线上拜年、除夕夜包饺子线上评比,也有劳动技能的线上培训。最让职工心里踏实的是,企业对在沪职工子女统一看护并安排高学历员工进行辅导。员工梁世志激动地说:“企业让我们感受到了在‘嘉’过年的暖意!”京东物流华东分公司也推出春节系列关爱活动,包括优秀员工慰问、装扮最有年味的“家”和开年送好礼活动等,营造浓浓的春节氛围。
