The Daegu District Court's 3-3 Criminal Case Division (Chief Judge Seong Kyung-hee) overturned the lower court's sentence of one year and six months in prison and three years of probation in the appeal of 46-year-old A, who was charged with attempted special injury, and sentenced him to one year in prison. It was announced yesterday (14th) that he was sentenced to two years of probation.



From February to April 2020, Mr. A was handed over to trial on charges of unsuccessful attempts to injure him by spraying mold remover on his husband's toothbrush, tongue cleaner, and face brush 15 times.



Person A requested a divorce after frequent marital quarrels due to a quarrel with her husband B, but when Mr. B refused to do so, it was investigated that he started the crime out of dissatisfaction with him.



After that, Mr. B, who felt pain in his stomach, was diagnosed with gastritis and esophagitis through a medical examination. Mr. B, who smelled a strange smell from his toothbrush, remembered the direction of the toothbrush, etc.



A's self-talks such as "Why don't you die", "I want you to die today", "I have to wait a few months" were recorded on the recorder and camera that B installed in the bathroom, along with the sound of spraying something.




The first trial court said, "It seems that not only the victim but also the defendant's children were severely traumatized by the crime. The sentence was decided based on the fact that he was reflecting on his wrongdoing, that the crime was only attempted, and that he was a first-time offender.”



The court of appeals also judged that "the method of the crime is very poor and the quality of the crime is poor", but explained the reason for the commute, saying, "The reason for the reduction of the sentence was that there was a low risk of recidivism and the fact that the victim did not want punishment after an amicable agreement."
