The Supreme People’s Court of China supports the opening up of frontier areas to strengthen the establishment of international commercial dispute resolution mechanisms, including support for border areas, important node cities, and core areas to explore regional bilateral and multilateral dispute resolution cooperation mechanisms, and establish joint dispute resolution platforms.
The "Opinions of the Supreme People's Court on the People's Court Providing Judicial Services and Guarantees for the Construction of Hainan Free Trade Port" issued on the 15th proposed that Hainan should be promoted to build an international commercial dispute resolution center.
"Introduce well-known international commercial arbitration institutions and international commercial mediation organizations to establish a'one-stop' international commercial dispute resolution mechanism that organically links mediation, arbitration and litigation." Tao Kaiyuan, Vice President of the Supreme People's Court, said at a press conference.
She introduced this judicial opinion and proposed measures including supporting overseas international arbitration institutions to establish business institutions in Hainan Free Trade Port to carry out arbitration business; supporting enterprises registered in the free trade port area to agree on specific locations, in accordance with specific arbitration rules, Specific personnel arbitrate related disputes; explore the appointment of Hong Kong, Macao and Taiwan residents as people's jurors, and introduce foreign and Hong Kong, Macao and Taiwan mediators to participate in dispute resolution.
The "Overall Plan for the Construction of Hainan Free Trade Port" has achieved initial results since its release in June 2020.
For example, the "New Deal" of tax exemption for outlying islands has achieved remarkable results. Average daily sales have more than tripled year-on-year, and sales will double by more than 32 billion yuan in 2020; another example is Yangpu's trial of "opening the first line and controlling the second line" import and export. According to the management system, containers exceeded 1 million TEUs last year, a year-on-year increase of 44%; another example is that from June 1, 2020 to the end of the year, Hainan Province has established more than 190,000 new market players, and newly established enterprises nearly tripled year-on-year First in the country.
Facing reality and new needs, a total of 30 judicial opinions cover the improvement of the free trade port’s legal construction system, the promotion of the establishment of a policy system compatible with high-level free trade ports, the promotion of the construction of a modern industrial system, and the creation of a social governance of joint construction, governance and sharing New pattern and participation in the construction of risk prevention and control system.
According to Wang Shumei, President of the Fourth Civil Tribunal of the Supreme People’s Court, the judicial opinions also focused on strengthening the construction of tourism courts, establishing a centralized and rapid trial mechanism for foreign-related tourism disputes, and building a “one-stop” diversified dispute resolution mechanism that adapts to the new tourism industry and model. Promote the construction of an international tourism consumption center; properly hear cases involving international cruise yacht disputes, and support Sanya in making provisions for the construction of an international cruise home port.
