Berlin (dpa / bb) - Because, as an employee of a foundation, he had concluded over 300 mobile phone contracts with devices without authorization and used or sold them for himself, a 33-year-old was sentenced to two years' probation.

The district court of Berlin-Tiergarten found the man guilty of commercial infidelity in 33 cases on Monday.

He was also ordered to do 100 hours of community service.

Shortly before the trial, the defendant had signed a notarial acknowledgment of guilt for around 487,000 euros.

As an employee of the cultural institution at the time, the man was entrusted with ordering cell phones and concluding contracts for the employees.

From the beginning of 2017 to September 2019, he took advantage of his position and concluded contracts to his advantage, said the judge.

He said he had "spent the money on expensive things and invited friends".

The 33-year-old had confessed.

Because he was “plagued by debts and mental health problems”, the deeds came about.

He said he had spent the money he got from selling cell phones on expensive clothes or traveling.

"When I spent money, I felt better and recognized," said the defendant.

Although the bills kept getting higher, the dizziness was not noticed for a long time.

"I was not checked."

He now has another job and pays back 500 euros a month.

An employee of the foundation said as a witness that in the summer of 2019 non-business-related cell phone orders were noticed.

A settlement was later reached with the provider and the damage was "roughly halved".

The indictment stated that the foundation had been obliged to pay contract fees of around 950,000 euros as a result of the unjustified contracts.

The verdict essentially corresponded to the requests made by the prosecution and defense.
