Munich (dpa / lby) - After the Bavarian Administrative Court (VGH) has temporarily overturned the Bavaria-wide alcohol ban in public spaces, the state government wants to allow local authorities again to allow local bans.

"The decision of the VGH is regrettable, as alcohol disinhibits and helps to deal more laxly with the absolutely necessary hygiene distances," the state chancellery informed the German press agency.

"We will therefore put the old regulation back into force, according to which the municipalities determine certain places where alcohol consumption in public spaces is prohibited."

On Tuesday, the VGH suspended the Bavaria-wide ban pending a decision in the main proceedings and thus granted an urgent application by a private person.

As a justification, the court said that according to the Infection Protection Act, alcohol bans are only provided in certain public places.

The order of a ban on alcohol for the entire area of ​​the Free State therefore exceeds the statutory authorization granted by the federal legislature.
