The government has launched a full investigation into whether 'malicious lessors' have signed up for charter guarantee insurance.



Although it has been mandatory for landlords to sign up for rental deposit return guarantee insurance since August 2020, it has been confirmed that there are many cases where the deposit was not returned to tenants without complying with it.



In the meantime, the government and local governments have not carefully checked whether landlords have fulfilled their subscription obligations, so in the case of 'Villa King' Mr. Kim (42), even in Gangseo-gu, Seoul, where victims appeared one after another, not a single fine for negligence was issued for not subscribing to guarantee insurance. didn't



According to the Ministry of Land, Infrastructure and Transport, each local government has been investigating whether landlords in their jurisdictions have insurance coverage since last month.



The target is 'intensively managed multi-housing debtors' managed by the Housing and Urban Guarantee Corporation (HUG).



HUG creates and manages a list of landlords who have not returned the deposit to the tenant and have paid back three or more times instead, or who have lost contact or who have not paid a penny of their guarantee debt in the past year. It was for confirmation.



As a result of the revision of the law, it became mandatory for all rental companies to sign up for guarantee insurance in August 2020, and existing rental companies had a 1-year grace period, and from August 2021, the obligation to sign up was erased.



It is the local government that is responsible for cracking down on this and imposing fines.



There was a criminal punishment rule that imposed a prison term of up to two years or a fine of up to 20 million won if you did not purchase guarantee insurance even though you were not initially exempted.



However, since January of last year, it has been alleviated by a penalty of 30 million won or less, reflecting the point that it is excessive for rental operators who want to sign up but cannot sign up due to strict insurance subscription requirements.

The problem is that charter scammers like 'Villa King' Kim, who died without returning the jeonse deposit after owning 1,139 houses, only told the tenants that they were obligated to purchase guarantee insurance because they were registered rental operators, but in reality did not sign up. that it didn't.



In the case of Gangseo-gu, Seoul, where victims of Mr. Kim's case appeared one after another, it was found that 71 households were not subscribed to by Mr. Kim, even though he was obliged to purchase insurance insurance.



However, there was not a single fine received by Mr. Kim from Gangseo-gu due to the lack of guarantee insurance.



There were only 7 fines imposed for selling houses without permission from the ward office during the rental period.



Mr. Kim reported the rental contract, saying that he was going to sign up for guarantee insurance, and the district office accepted the report, saying that he would supplement the documents later.



This is because it usually takes 1 to 2 months to sign up for guarantee insurance after signing a lease contract.



Afterwards, even though Mr. Kim did not submit the documents for signing up for the guarantee insurance, he did not pay a fine because it was not confirmed, and as damage continued, the government and local governments belatedly launched a fact-finding investigation.



Penalties for not signing up for guarantee insurance are 5% of the deposit for 3 months or less, 7% of the deposit for 3 months to 6 months, and 10% for more than 6 months depending on the period of non-registration.



Assuming that the average deposit for the house where Mr. Kim had rented was 150 million won, he could receive a fine of over 1 billion won only in Gangseo-gu, Seoul.



Mr. Kang, a victim of Mr. Kim's case, said, "Even though he broke the law by not signing up for guarantee insurance, Mr. Kim was able to continue to purchase houses and continue the rental contract as an individual rental business." "Why is there no sanctions in the country? I want to hear the answer as to whether it was left unattended."

As the rental business became compulsory to subscribe to guarantee insurance, the subscription itself increased significantly.



According to data submitted by HUG by Rep. Park Sang-hyeok of the Democratic Party of Korea, a member of the National Land, Infrastructure and Transport Committee, there were only 14 individual rental business owners who signed up for guarantee insurance in 2019, but 1,06 in 2020, 21,724 in 2021, and last year It increased to 42,049.



In August 2021, as the existing rental business was obliged to sign up for guarantee insurance, the number of rental businesses signed up has nearly doubled in the past year.



The number of guaranteed households increased to 119,219 last year, 26 times the 4,627 households in 2020 and 1.4 times the 83,033 households in 2021.



The number of guaranteed households by corporate rental operators increased by 43% from 186,151 households in 2020 to 228,449 households last year.



However, it is estimated that there are still many rental operators who do not purchase guarantee insurance.



In order to avoid the obligation to sign up for guarantee insurance, rental operators intensively signed a lease contract just before August 2021, and many households are included in the mandatory subscription in earnest from August this year.
