medical

leave will no

longer

have the obligation to deliver a copy of the medical report

to the company, the managing entity or the mutual, since the issuing entities of these reports and the National Institute of Social Security They will be communicated electronically, according to the Royal Decree that modifies Royal Decree 625/2014 and that was approved by the Government in its Council of Ministers on December 27.

Once the rule is published in the Official State Gazette (BOE) and enters into force, this change in procedure will take place, the objective of which is

to avoid "procedures that can be burdensome

for people who are temporarily incapacitated and taking advantage of the possibilities of improving effectiveness and efficiency offered by advances in

digitization and

information technologies", according to the Government.

The worker

will no longer have to go personally to his company

, within a maximum period of

three days

, as was the case until now, to deliver the medical leave report and, therefore, he will no longer be exposed to a penalty if he does not do so in the established term.

The previous norm contemplated the possibility that the employee -who could have a broken leg, for example- delegated the delivery of the document to a relative or representative, but there were

situations in which the company did not receive the report

in due time and form, which he could even use to justify a dismissal, since he needed that part to process the exemption from the payment of social contributions for the worker on leave.

From now on these risks do not exist, since the company will be able to carry out

the procedures online.

"By means of this royal decree, changes are introduced in certain aspects of the management and control of the processes for temporary disability (IT) in the first 365 days of their duration, in order to

expedite procedures and eliminate bureaucratic obligations

that unnecessarily prolong the processes, which represents an important benefit for companies, workers and for the doctors of the Public Health Services themselves", stressed the Executive.

The modified standard is the one that regulates precisely some aspects of the management and control of processes for temporary disability in the first year of duration.

In addition, it is clarified that, in the IT processes, the doctors of the Public Health Service, the collaborating company or the mutual may

set medical review periods shorter

than those indicated in the Royal Decree, depending on the evolution of the process. .

"In this way, it is about avoiding interpretative doubts caused by the current wording of the standard," they point out.

In the event that

the cancellation is renewed,

the entire process will also be done electronically without the need for new documentation to be submitted.
