This is the first time China has enacted legislation on the protection of black land.

  In order to implement the relevant provisions of the law, the General Office of the Ministry of Natural Resources recently issued the "Notice on Further Strengthening the Protection of Black Soil Cultivated Land" (hereinafter referred to as the "Notice"), requiring the natural resources departments of four provinces (regions) including Inner Mongolia, Liaoning, Jilin and Heilongjiang. Effectively strengthen the protection of black soil cultivated land, and strictly control the use of cultivated land.

  Black soil arable land is a precious soil resource, and it is the "giant panda" in arable land, and plays an extremely important role in ensuring national food security.

However, after years of development and utilization, the black soil cultivated land has become thinner, thinner and harder, which brings challenges to the sustainable development of agriculture. Effective measures must be taken to protect the black soil cultivated land and provide strong support for ensuring national food security.

  Accurately grasping the background of black soil cultivated land is the basis for the protection of black soil cultivated land.

The "Notice" requires that the natural resources departments of the four provinces (autonomous regions) should work with relevant departments to organize and carry out surveys of black soil arable land.

Using the current cultivated land data of the annual national land change survey and the national soil census data of seven types of black soil soil types, we can further clarify the types, distribution, quantity, quality, protection and utilization status of black soil cultivated land in the black soil area, and establish black soil cultivated land files. .

  The "Notice" emphasizes the need to strengthen the special management and control of black soil cultivated land in national land spatial planning.

The "Notice" requires that the competent departments of natural resources at all levels in the four provinces (autonomous regions) should include all black soil arable land in the red line task of arable land protection in the preparation of national land space planning and the delineation of "three districts and three lines". Black soil cultivated land with good properties should be prioritized as permanent basic farmland, put into storage on a plot-by-plot basis, and strictly implement special protection.

  The "Notice" clarifies that it is necessary to strictly control the occupation of black soil arable land by construction projects.

Construction projects shall not occupy black soil arable land, and if it is indeed difficult to avoid it, in the feasibility study stage, the necessity and rationality of occupation must be strictly demonstrated and included in the arable land survey and demonstration report; Black soil fills black soil” and the stripping and reuse of plough layer soil, formulate a plan for plough layer soil stripping and reuse according to regulations, so that it should be stripped off as much as possible, properly stored after stripping, and reused in a timely and reasonable manner.

  In terms of strictly implementing the responsibility for the protection of black soil cultivated land, the "Notice" emphasizes that the task of protecting black soil cultivated land should be included in the responsibility goal of cultivated land protection, and strict assessment should be implemented, and the party and government should be equally responsible.
