A reporter asked at the meeting: Accelerating the transformation and application of patents is very important to provide new momentum for economic development.
At present, there are many patents that need to be transformed in colleges and universities, but at the same time, small, medium and micro enterprises are also facing the problem of lack of technology.
May I ask what work the State Intellectual Property Office has done to meet the needs of colleges and universities and small, medium and micro enterprises and promote the transformation and transfer of intellectual property rights?
Lei Xiaoyun, director of the Intellectual Property Promotion Department of the State Intellectual Property Office, said that the transfer and transformation of intellectual property rights is a very important task, which is of great significance for improving the innovation capabilities of small and medium-sized enterprises and cultivating new momentum for development.
In recent years, the State Intellectual Property Office has taken a series of measures in terms of policy guidance and system supply to accelerate the transformation of intellectual property rights into real productive forces.
The first is to further promote the special plan for patent transformation.
In March last year, the State Intellectual Property Office and the Ministry of Finance issued the "Notice on Implementing the Special Plan for Patent Transformation to Help Small and Medium-sized Enterprises' Innovation and Development", and 30 provinces responded positively and launched the implementation of the special plan.
In May of this year, the two departments issued the "Notice on Doing a Good Job in the Special Plan for Patent Transformation in 2022", continued to further promote the implementation of the special plan, and successively identified 16 provinces with outstanding results for key support.
The relevant localities have promoted the transformation and implementation of patented technologies from universities and institutes to small and medium-sized enterprises in terms of broadening supply channels, stimulating transformation vitality, smoothing supply and demand docking, and improving supporting services, and have achieved good results.
According to statistics, in 2021, the number of patent transfer licenses in colleges and universities nationwide will reach 27,000, a year-on-year increase of 33%, which is nearly twice the overall growth rate of national patent transfer licenses.
Among them, the number of patent transfer licenses, the number of license transfers to small and medium-sized enterprises, and the number of benefited enterprises in 16 key provinces, universities and institutes all account for about 90% of the national total. The guiding role and implementation effect of promoting patent transfer and transformation are remarkable.
The second is to speed up the implementation of the patent open licensing system.
Patent open licensing is a new system created by the fourth revision of the Patent Law. It is a simple and quick "one-to-many" licensing method, which helps to promote the connection between supply and demand, improve negotiation efficiency, reduce institutional transaction costs, and facilitate the transformation and application of patents. New ways and new models are provided.
Since the beginning of this year, in order to promote the smooth start and efficient operation of the open patent licensing system, the State Intellectual Property Office has held a special meeting to study and deploy the implementation of open patent licensing, and issued the Work Plan for Promoting Open Patent Licensing to the departments within the bureau. The Intellectual Property Office has issued the "Patent Open Licensing Pilot Program". It plans to mobilize more than 100 colleges and universities to participate in the pilot program by the end of 2022, and achieve more than 1,000 patent licenses, effectively improving the effectiveness of patent transformation.
At present, 13 provinces have issued pilot programs, and 6 provinces have organized 77 colleges and universities to screen and publish 3,375 patents for open licenses, which are precisely matched and pushed to 19,000 small, medium and micro enterprises, and 587 license contracts have been reached.
Lei Xiaoyun said that in the next step, the State Intellectual Property Office will conscientiously implement the decisions and deployments of the CPC Central Committee and the State Council, solidly promote the implementation of the special plan for patent transformation and the patent open licensing system, release the filing data of patent license contracts, and issue guidelines for national patent evaluation. Standard, provide method guidance and data reference for open license pricing, and make efforts from the supply side of colleges and universities and the demand side of small and medium-sized enterprises to promote the transformation of innovation achievements of colleges and institutes, and promote the stable and healthy development of the economy.
