Recently, under the guidance of the State Administration for Market Regulation, the Shaanxi Provincial Administration for Market Regulation, in accordance with the Anti-Monopoly Law, organized the Shaanxi Cement Association to organize Yaobai Special Cement Group Co., Ltd., Shaanxi Jinyu Jidong Cement Economic and Trade Co., Ltd., East Heidelberg (Jingyang) Cement Co., Ltd., Jidong Heidelberg (Fufeng) Cement Co., Ltd., Shaanxi Shengwei Building Materials Group Co., Ltd., Tongchuan Shengwei Building Materials Co., Ltd., Shaanxi Ecological Cement Co., Ltd., Liquan Conch Cement Co., Ltd., Qianxian County Conch Cement Co., Ltd., Shaanxi Tongchuan Phoenix Building Materials Co., Ltd., Baoji Zhongxi Jinlinghe Cement Co., Ltd., Baoji Zhongxi Phoenix Mountain Cement Co., Ltd. and Qianyang Conch Cement Co., Ltd. reached and implemented monopoly agreements. Administrative penalties were imposed for illegal acts, the parties were ordered to stop the illegal acts, and a total of about 451 million yuan was fined.
At the same time, the "Administrative Guidance" was issued to the parties concerned, and 12 administrative guiding opinions were put forward from four aspects: "seriously study anti-monopoly supervision policies, comprehensively regulate their own competition behaviors, improve the internal competition compliance system, and maintain a good competition order in the industry". Provide clear guidelines for the parties to operate in compliance with laws and regulations, and require them to carry out comprehensive rectification in strict accordance with the Anti-Monopoly Law to achieve standardized, healthy and sustainable development.
In July 2019, according to the report, the Shaanxi Provincial Market Supervision and Administration Bureau officially filed an investigation on the Shaanxi Provincial Cement Association and the cement enterprises involved.
During the period, on-site investigation was carried out in accordance with the law, and relevant personnel were interviewed, reviewed and copied relevant documents and materials, and obtained a large amount of evidence; extensive investigation and evidence collection were carried out on relevant upstream and downstream enterprises in the cement industry;
After investigation, from July 2017 to March 2019, the cement enterprises involved negotiated and reached an agreement on the selling price of cement products many times in industry conferences, gatherings, WeChat chats and other activities organized or voluntarily organized by the Shaanxi Cement Association. A price increase of the same or similar magnitude is implemented at the same time.
The investigation showed that the above-mentioned illegal acts excluded and restricted the competition in the cement market in Guanzhong area of Shaanxi Province, disrupted the market order of fair competition in the building materials industry, and harmed the interests of consumers and the public interest. Article 3 "Prohibits competitive operators from reaching the following monopoly agreements: (1) Fixing or changing commodity prices", the above-mentioned behavior of Shaanxi Cement Association violates Article 16 of the Anti-Monopoly Law, "The industry association shall not organize the operators of an industry to engage in monopolistic conduct prohibited by this chapter”.
