If reconciling professional life and family life is already difficult in normal times, it can become a real nightmare when the state of health of your child requires a constant presence and restrictive care.

The law has therefore set up parental presence leave, dedicated to employees whose children have a serious illness or disability.

Exceptional situations

This type of exceptional leave requires the production of a medical certificate attesting that the child is affected by a particularly serious illness or handicap, or that he has suffered a disabling accident, but also justifying the need for his parent to be present at its ratings.

Similarly, the latter must be under 20 years old, not personally benefit from any housing allowance or family allowance and not receive a salary of more than 1,008.51 euros gross monthly.

We are targeting here a child in the effective and permanent care of his parent.

A simple request

In order to be able to take care of their child properly, the employee can therefore apply for parental presence leave from their employer at least 15 days before the desired leave date.

He must then proceed by registered letter with acknowledgment of receipt, attaching the required medical certificate to his approach.

In this context, the law then makes it possible to benefit from 310 working days of leave (in other words 62 weeks, at the rate of 5 days worked per week), to be used continuously or split up, according to needs, but within the limit of up to three years.

It is also possible to transform this leave into a period of part-time activity, and even to split it into half-days.

In all cases, the employer must be informed 48 hours before going away, except for a sudden deterioration in the child's state of health.

Faced with pathologies that are sometimes very long, the law of November 15, 2021 also makes it possible to benefit from a second leave at the end of three years or when the 310 days granted have been exhausted.

In total, the parent can therefore benefit from 620 days, in the event of relapse or recurrence of the disease and provided that they follow the same procedure.

An allowance to hold

Although parental presence leave makes it possible to safeguard the employee's job and his social rights (calculation of seniority, training rights, resumption of the position or a similar position on return), it nevertheless suspends the employment contract and thus deprives the parent concerned of his salary.

To make ends meet, the law has set up a daily parental presence allowance (AJPP), which must be applied for at the Family Allowance Fund, directly online at Caf.fr or at the counter using the cerfa n form. ° 12666, attaching the medical certificate.

If the organization agrees, the employee may then receive 60.14 euros per day or 30.08 euros per half-day for the duration of the parental presence leave.

A supplement for costs may even be added in the event of expenses required by the child's state of health.

Please note: a monthly certificate specifying the number of days of absence during the month must be completed by the employer throughout this period.

Similarly, this allowance cannot be combined with other aid from CAF.
